HomeMy WebLinkAboutRESOLUTIONS - 05081990 - 90/273THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on Mav 8 , 1990 by the following vote: AYES: Supervisors Powers , Schroder, McPeak, TorlakFon, Fanden NOES: None ABSENT: None ABSTAIN: None SUBJECT: Determination of Property ) Tax Transfer for the Oakwood ) RESOLUTION NO. 90/ 273 Annexation to the City of ) Clayton (LAFC 90-13) WHEREAS, the Revenue and Taxation Code provides that the City and the County shall agree to exchange property tax revenues between themselves to reflect transfer of service responsibilities resulting from annexation of territory to the City; and the Revenue and Taxation Code further provides that when responsibility for providing a service is transferred from one special district to another, the Board of Supervisors shall determine the amount of property tax revenues to be exchanged between the districts; and WHEREAS, the Oakwood Annexation to the City of Clayton (LAFC 90-13) involves annexation of territory to the City of Clayton for which property tax exchange is determined by the previously approved master property tax exchange agreement; and WHEREAS, the annexation proposal involves concurrent annexation to the Contra Costa County Fire Protection District, and detachment from the East Diablo Fire Protection District; NOW, THEREFORE, BE IT RESOLVED THAT THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY DOES HEREBY DETERMINE that 100 percent of the property tax accruing to the East Diablo Fire Protection District from the affected territory of the Oakwood Annexation to the City of Clayton (LAFC 90-13) shall be transferred to the Contra Costa County Fire Protection District. The terms of this property tax exchange agreement shall be effective for the fiscal year for which the State Board of Equalization makes the tax rate area changes for this jurisdictional change and shall apply in subsequent years unless changed by the mutual agreement of affected agencies or subsequent jurisdictional changes. This resolution does not change the property tax revenues accruing to other agencies servicing the subject territory or the affected agencies right to collect taxes for existing bonded indebtedness. The property tax exchange agreement discussed above shall apply to affected territory as submitted or revised by the Local Agency Formation Commission. This resolution is supplemental to the existing master property tax exchange agreement between the City of Clayton and the County of Contra Costa which is also operative with respect to the subject jurisdictional change.
