HomeMy WebLinkAboutRESOLUTIONS - 04241990 - 90/239x. 51 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on April 24, 1990 by the following vote: AYES: SupervisorF Schroder, McPeak, Torlakosn, Fanden NOES: None ABSENT: SuperviFor Powero ABSTAIN: None SUBJECT: In the Matter of Fixing ) the Amount of Official ) RESOLUTION NO. 90/239 Bonds And Self-Insuring ) All Official Bonds up to ) 50,000 Pursuant to State of California Government Code section 24150, the Board of Supervisors of Contra Costa County is required to fix the amount of official bonds of certain officers of Contra Costa County for the ensuing four years commencing the first Monday after the first day of January 1991 . Pursuant to State of California Government Code section 24156 , the Board of Supervisors of Contra Costa County may, by resolution, adopt a program of self-insurance in lieu of bonds for any officer or employee employed by the County or for the officers or employees of any district, the governing board of which is the Board of Supervisors of Contra Costa County, or for any officer or attachee of any court supported in whole or in part by Contra Costa County. Pursuant to State of California Government Code section 24154 , the Board of Supervisors of Contra Costa County may include officers requiring official bonds as covered employees in any master bond used in the County. NOW, THEREFORE, IT IS BY THE BOARD RESOLVED that the amount of the official bonds of the officials listed below is hereby fixed as follows , to wit: Treasurer-Tax Collector 200,000 Treasurer-Tax Collector (License Collector) 10,000 County Clerk-Recorder 10, 000 County Auditor 50,000 Assessor 10, 000 District Attorney-Public Administrator 10,000 Sheriff-Coroner 10,000 Sheriff-Coroner (Civil Duties ) 10,000 Sheriff-Coroner (Criminal Duties) 10, 000 Sheriff-Coroner (Coroner Duties )10, 000 Superintendent of Schools 10, 000 Surveyor 10, 000 IT IS FURTHER RESOLVED that a program of self-insurance in lieu of bonds is hereby adopted for all officials with one or more official bonds of $50, 000 or less . IT IS FURTHER RESOLVED that the County maintain a public employees' blanket bond covering the $200,000 bond of the Treasurer-Tax Collector. RESOLUTION NO. 90/239 IT IS FURTHER RESOLVED that the foregoing program of self- insurance in lieu of bonds is hereby adopted for the deductible amount of the County's public employees ' blanket bond as applied to the Treasurer-Tax Collector. Fixing and Self-Insuring the Amount of llt Official Bonds SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONt Adopt a resolution fixing the amount of official bonds and ordering that the County self-insure those bonds and amend the County' s public employees ' blanket bond to include the amount of the official bond of the Treasurer-Tax Collector. FINANCIAL IMPACT: This action eliminates the need for certain public officials to post separate bonds that cost in excess of $5,000 for four years coverage. In lieu of bonds, the exposure would be covered by the County's self-insurance program and by amending the County' s public employees' blanket bond. REASONS FOR RECOMMENDATION/BACKGROUNDS Government Code section 24156 allows the County to self- insure in lieu of bonds for any officer or employee, and section 24154 allows the County to include public officials requiring official bonds in its master bond. The County currently maintains a public employees' blanket bond in the amount of 5, 000, 000, with a self-insured deductible of $50, 000 . The blanket bond covers all County officers and employees, including those public officials requiring official bonds, but does not cover the official bonds . The blanket bond can be- amended so that it includes official bonds above the $50, 000 deductible. The Risk Manager recommends that the County self-insure official bonds of $50, 000 or less and amend the blanket bond to include the official bond of the Treasurer-Tax Collector ($200,000) and self-insure the $50,000 deductible, thereby eliminating the need for separate insurance coverage for public officials requiring official bonds .
