BACKGROUND: When this matter was before the Board of Supervisors on January 13, 1987 , the report was put over with the request that the County Administrator provide additional data specifically relating to the designation of surface streets within Contra Costa County for the transportation of radioactive waste. Further clarification has been sought from the California Highway Patrol in Sacramento. They have confirmed that their draft regulations do not include the designation of any surface streets or highways within Contra Costa County for the transportation of radioactive waste. Surface streets are designated within the City of Oakland to allow the transportation of radioactive wastes to and from the Port of Oakland. However, there is no such designation for streets leading to and from the Port of Richmond. The CHP cautions, however, that since the proposed regulations were rejected by the Office of Administrative law as not complying with federal law and regulations, the CHP is unable to indicate at this time what routes might be designated if and when acceptable regulations are redrafted. This office will continue to monitor this subject and advise the Board when any further developments occur. In the meantime, the proposed regulations, which are attached, designate no streets or highways for the transportation of radioactive wastes through the County. In Northern California the general north-south route is Interstate 5. The general east-west routes are Interstate 80 east of Interstate 5, and Interstate 580 west of Interstate 5 . None of these routes include highways within Contra Costa County. Transportation of Radioactive Materials 1180 . Scope . This Article applies to the on-highway transportation of fissle III radioactive materials and a highway route controlled quantity of radioactive materials as defined in Title 49 , Code of Federal Regulations , Section 173 . 403 , as published November 1, 1985 . Except as provided in Sections 1180 . 2 and 1180 . 3 , radioactive materials shall be transported only upon the routes shown on Maps 1 through 7 contained in Sections 1181 through 1187 . Reference : Sections 33000, 34501 , and 34506, Vehicle Code . 1180 . 2 Nondesignated Routes . a) A route other than a designated route may be used only under the following conditions : (1) In the event of a natural disaster, traffic accident, or other unexpected event resulting in closure of a designated route and the most direct route is used to bypass the road closure and return to a designated route, (2)_ When travelling directly to or from a fuel , food, or rest stop, or (3 ) When necessary to comply with the orders of a traffic officer . Temporary Routes (a) Use of a temporary route for a period not to exceed 180 days may be approved by the Department under the following conditions : (1) When a shipment is necessary to/from an area where no designated route exists , and (2) When, prior to use, a written request stating the purpose, need, and duration of use of the route is submitted to : California Highway Patrol Commercial and Technical Services Section 2555 First Avenue P.O. Box 942898 Sacramento, CA 94298-0001 and S3 When a letter of approval. or a reproduction thereof is carried in the transporting vehicles and presented to a traffic officer upon request.
