THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on APRIL 3, 1990 by the following vote:
AYES: Supervisors Powers, Schroder, McPeak, Torlakson and Fanden
NOES: None
ABSENT: None
ABSTAIN: None RESOLUTION NO. 90/199
SUBJECT: APPROVE DEPOSITS BY DRAINAGE AREAS 29C, 40A, AND 46 TO THE
FLOOD CONTROL REVOLVING FUND AND A LOAN FROM THE FUND TO
DRAINAGE AREA 52D, COUNTYWIDE.
WHEREAS the following entities have amounts of funds that are temporarily not needed
and are available for deposit into the Flood Control District Revolving Fund:
Drainage Area 29 (2555) 140,000
Drainage Area 40A (2565) 110,000
Drainage Area 46 (2578) 300,000
TOTAL:550,000
WHEREAS the following entity needs a loan in the amount indicated:
Drainage Area 52D (2584) 550,000
WHEREAS a Revolving fund loan is required for Drainage Area 52D for the purchase of
a portion of the right of way required for Detention Basin No. 2; and
WHEREAS said loan shall be repaid to the depositing entities within three years from the
date of disbursement from the fund from monies available to said entity through drainage
fees, and the repayments shall include interest on the unpaid balance at 8.6 percent per
annum, which is the current rate received on similar types of investments by Contra Costa
County as determined by the County Treasurer.
NOW THEREFORE BE IT RESOLVED, as the Governing Board of Contra Costa County
rol and Water Conservation District, that said deposits and loan are approved.

TO: BOARD OF SUPERVISORS, as the Governing Body of the Contra Costa County Flood
Control and Water Conservation District
FROM: J. MICHAEL WALFORD, CHIEF ENGINEER

SUBJECT: Drainage Area 52D Basin
Project No.: 7584-6D8350 Task: ACO Account: 3540
SPECIFIC REQUEST(R OR 1ENDATIMIR a BACICGRO M AND.lUST1FIGATM
I. Recommended Action:
A. APPROVE Right of Way Contract and ACCEPT Grant Deed dated March 12, 1990, from
Johnie and Sharon Darst.
B. AUTHORIZE Chief Engineer to execute said Right of Way Contract on behalf of the
District.
C. APPROVE payment of $537,200 for said property rights and AUTHORIZE the Auditor-
Controller to issue a check in said amount payable to Founders Title Insurance Company,
Escrow No. 104740, to be forwarded to the Real Property Division for delivery.
D. DIRECT the Real Property Division to have the above referenced Grant Deed recorded
in the office of the County Recorder.
11. Financial Impact:
Payment of $537,200 from Drainage Area 52D funds.
III. Reasons for Recommendations and Background:
These property rights are required for the DA 52D Basin project in accordance with approved
plans and specifications.
nsequences of Negative Action:
The project will not have sufficient land rights to allow construction in accordance with the
approved plans and specifications.
