HomeMy WebLinkAboutMINUTES - 02031987 - 1.31 70: BOARD OF SUPERVISORS " FROM: Phil Batchelor Contra County Administrator Costa DATE: January 26, 1987 C0J SUBJECT: Legislation: Assembly Bill 167 (Mountjoy) SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION• Adopt a position of opposition to AB 167 by Assemblyman Mountjoy which would increase the fine on driving under the influence convictions by $200 and direct the funds to the installation of wrong-way spikes on freeway ramps. BACKGROUND: Assemblyman Mountjoy has introduced AB 167 . This bill would increase the fine for driving, or causing bodily injury, while. driving under the influence of an alcoholic beverage, any drug, or both, by $200. This revenue would be turned over to the State and used exclusively by the State to install wrong-way spikes on freeway off-ramps. An increase in the fine by $200 would also generate an additional $140 in penalty assessments. This means a total increase of $340 for a conviction of driving under the influence. We believe the Board of Supervisors should oppose AB 167 on the following grounds: 1. County revenue flow would be slowed down because the State shares immediately in the payment of any fine on an installment basis and most DUI fines are paid on an installment basis. 2. Increases of this size will undoubtedly result in more defaults in fine collection and thereby make it more difficult for the County to collect the money owed the County. 3 . Increases of this magnitude for a single State program will make it more difficult, if not impossible, for the County to achieve passage of legislation imposing much more modest fine increases and penalty assessments for programs, such as courthouse construction, payment of the administrative costs of the courts, and for alcohol rehabilitation programs. For these reasons, we believe the Board of Supervisors should actively oppose AB 167 . The Clerk-Administrator of the Walnut Creek--Danville Municipal Court also recommends that the Board oppose AB 167 .
