HomeMy WebLinkAboutMINUTES - 02031987 - 1.3 (2) TO: BOARD OF SUPERVISORS 1. 3-0 FI$OM: Phil Batchelor l./tJl tra County Administrator Cx)sta DATE: January 28 , 1987 C SUBJECT: Legislation: Assembly Bill 140 ( Stirling) SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION RECOMMENDATION• Adopt a position of opposition to AB 140 by Assemblyman Larry Stirling which would require local general plans to contain a vehicle trips and passenger trips mitigation element which would have to conform to regulations adopted by the California Transportation Commission ( CTC) . The element would have to be updated annually and would require annual certification of the element, its updates and local progress toward achieving reductions in vehicle and passenger miles by CTC. Failure to obtain the required certification would result in loss of eligibility for State funding of local highways, streets, and roads. BACKGROUND: A requirement for an element in the general plan dealing with goals for reducing vehicle trips and passenger trips may well be a useful and valid requirement. However, without any idea of what may be in the regulations which would be adopted by CTC, it is difficult to know whether the requirement is reasonable or not. However, to threaten to withhold all State highway funds because CTC is unhappy with the progress being made to achieve reductions in vehicle trips and passenger trips seems to allow the State to intrude into local land use planning decisions unnecessarily and inappropriately. Other required elements which must be included in the General Plan are more detailed regarding their content, allow considerable discretion in how they are drafted and do not include this type of heavy-handed threat to withhold funds if a State agency is unhappy . with the County' s progress in a particular area. In addition, the bill appears to assume that a reduction in passenger miles traveled on public highways, streets and roads is both feasible and valuable. This County is concerned about the transportation problems in this County. Steps are being taken to encourage carpooling and other elements of a transportation systems management program. Such a program is far more complex and sophisticated than simply reducing the number of miles traveled on public highways, which appears to be the sole focus of this bill. For these reasons, it is recommended that the Board oppose AB 140.
