HomeMy WebLinkAboutMINUTES - 02241987 - S.3 e TO: ;3 BOARD OF SUPERVISORS FROM: Supervisor Nancy Fanden Contra Costa DATE: February 10, 1987- County SUBJECT: IT HAZARDOUS WASTE POND CLOSURE AND MODERNIZATION PLAN SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION: I There are a number of questions regarding the current IT pond closure plan and application for a new treatment facility that need to be answered: 1. There are three deadlines to close the ponds: Toxic Pits Act Dec. 31, 1988 County July 1, 1988 Fed. Res. Conservation Recovery Act (RCRA) Nov. 4, 1988 Are these actions e4forceable? Where will hazardous waste be sent in the event that the ponds are closed and the proposed treatment plant is not permitted or is permitted, but not in operation? 2. Is there an adequate enforcement procedure (such as a performance bond) in effect to ensure cleanup in the event that the operator defaults? I 'm asking this question only to ensure that the County is fully protected and am not questioning theiapplicants intentions. 3 . The Baker ponds, which I understand are still receiving waste, are said �to be within the Alquist-Priolo Special Seismic Study Zone locating the Concord Fault. We need to know specifically why the ponds are allowed to continue operating when the fault location has not been described? If there is any threat of contamination, should the ponds be drained and closed immediately? IT provideda project flow chart last year which is now out of date. Please provide a realistic schedule describing the process and outlining the responsibilities of involved agencies. 5. Because this process will ultimately be of great expense to the County, please review all methods of reimbursement. BACKGROUND: IT is located in a highly environmentally sensitive area, between two creeks and upwind from an existing neighborhood. Because of the number of agencies involved, and the Counties responsibility, we must have a clear understanding of the process to ensure that the best interest of the community as a whole is met. i i I . i
