SUBJECT: Further Consideration of Recommendations of the Housing and Community
Development Advisory Committee for Use of the County' s 1987-88
Community Development Block Grant Funds
SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1. Approve the recommendation of the Housing and Community Development
Advisory Committee with the following additions:
a. Antioch Babe Ruth Lighting $12,500
b. Project Seed - North Richmond $ 9,720

c. Legal Services Foundation Retain Funding at $15,000
In addition, direct staff to establish criteria for the North Richmond
Land Acquisition project for affordable housing including submissions to be
reviewed and negotiated by staff and the Housing and Community Development
Advisory Committee.
2 . Supervisor Powers recommends funding the Antioch Senior Center Expansion
for $28,900 matching a city contribution of a like amount.
Supervisor Schroder does not recommend funding the Antioch Senior Center"
Expansion because the City' s original decision to design the facility
without additional restrooms was a conscious decision to proceed in that
manner.
3 . Approve a reduction of up to 14% in funding for each project should Federal
funds be reduced.
4. Adopt the Proposed Statement of Community Development Objectives and
Projected Use of Funds as the Final Statement of Community Development
Objectives and Projected Use of Funds.

5. Assure and certify thai the County will comply with the regulations,
policies, guidelines and requirements with respect to the acceptance and
use of federal funds for this federally assisted program and given
assurances and certifyicompliance with the attached list of
certifications.
6. Find the economic development activities are necessary and appropriate to
carry out the County' s Community Development program.
7. Authorize the Chair the execute the appropriate documents and transmittal
letter for submissionjto HUD by the Director of Community Development.

8. Authorize Chair to sign letters to Congressional representatives requesting
their support to avoid future budget cuts in the Community Development
Block Grant Program.
FINANCIAL IMPACT
1987-88 CDBG Contingency Fund would be reduced by up to $51,120 leaving approxi-
mately $150, 000 on April 1, 1987. All federal funds.
BACKGROUND AND JUSTIFICATION
On February 10, 1987 after considerable testimony requesting modifications in
the Proposed Statement of Community Development Objectives and Projected Use of
Funds under the Community Development Block Grant Program for 1987-88, as
recommended by the Housingland Community Development Advisory Committee, the
Board of Supervisors referred the matter to the Finance Committee for review.
The Finance Committee reviewed the testimony and further discussed these matters
with staff and the requesting agencies on February 18, 1987.
Antioch Senior Center Expansion - The City advised the Finance Committee that it
would endeavor to provide half the funding $28,900 to match the County' s funds.
Antioch Babe Ruth Fields Lighting - The City has indicated a willingness to
provide $12, 500 and the Housing Authority $10,000 to match $12, 500 from the
County.
Project SEED - An allocation of one half that requested $9,720 would enable the
project to continue until the Richmond School District can consider further
permanent funding.
Legal Services Foundation - The legal housing counseling including tenant
eviction defense should be evaluated annually to determine its benefits.
North Richmond Land Acquisition - Two agencies requested funding to develop
affordable housing. Both proposals are premature given financing and planning
considerations. Staff will prepare criteria for submittal of proposals from
these agencies and any other interested developers.
Congress has until March 15, 1987 to approve the President' s request to rescind
$375 million. An approval would cost the County almost $400, 000. However, all
information coming from Washington, D.C. at this time indicates that the chances
of approval of the rescission are almost nil. In fact, HUD has advised us that
submittal of our grant application for the full amount is acceptable. A few
construction activities without other sources of funds would be unable to go
forward if the cuts took place on an across-the-board basis.
This is the Thirteenth year -of the Community Development Block Grant Program
which is intended to primarily benefit low and moderate income persons in the
urban County. The 1987-88 program provides that all funds will be utilized to
benefit low and moderateiincome persons.

CERTIFICATION'S
The grantee certifies that:
(a) It possesses legal authority to make a grant submission and to execute a
community developmeta4 and housing program;
(b) Its governing body has duly adopted or passed as an official act a resolution,
motion or similar action authorizing the person identified as the official
representative of the grantee to submit the final statement and all understandings
and assurances contained therein, and directing and authorizing the person
identified as the offioiel representative of the grantee to act in connection with
the submission of the final statement and to provide such additional information
as may be required;
(c) Prior to submission of its final statement to HUD, the grantee has:
(1) met the citizen participation requirements of S 570.301(aX2) and has
provided citizens with:
(A) the estimate of the amount of CDBG funds proposed to be used for
activities that will benefit persons of low and moderate income; and
(B) its plan for minimizing displacement of persons as a result of activities
assisted with CDBG funds and to assist persons actually displaced as a result
of such activities;
j (2) prepared its final statement of community development objectives and
projected use of funds in accordance with S 570.301(aX3) and made the final
statement available to the public;
(d) The grant will be conducted and administered in compliance with:
(1) Title VI of the Civil Rights Act of 1964 (Pub. L. 88-352; 42 U.S.C. S2000d
et seg.); and
(2) Title VIII of the Civil Rights Act of.1968 (Pub. L. 90-284; 42 U.S.C. 53601
et seg.);
(e) It will affirmatively further fair housing;
(f) It has developed its final statement of projected use of funds so as to give
maximum feasible priority to activities which benefit low and moderate income
families or aid in the prevention or elimination of slums or blight; (the final
statement of projected use of funds may also include activities which the
grantee certifies are designed to meet other community development needs
having a particularI urgency because existing conditions pose a serious and
immediate threat to the health or welfare of the community, and other financial
resources are not available); except that the aggregate use of CDBG funds
received under section 106 of the Act and, if applicable, under section 108 of the
Act, during the � 1987 program year(s) (a period specified by
the grantee consisting of 1, 2, or 3 program years, e.g., 1984 be 1985), shall

principally benefit persons of low and moderate income in a manner that ensures
that not less than 51 percent of such funds are used for activities that benefit
such persons during such period;

(g) 1t has developed a comi munity development plan, for the period specified in
paragraph (f) above, that identifies community development and housing needs
and specifies both short and long-term community development objectives that
have been developed in accordance with the primary objective and requirements i
of the Act;
(h) It is following a current housing assistance plan which has been approved by HUD
pursuant to S 570.306;

(i) It will not attempt to recover any capital costs of public improvements assisted
in whole or in part with funds provided under section 106 of the Act or with
amounts resulting from a guarantee under section 108 of the Act by assessing
any amount against properties owned and occupied by persons of low and
moderate income, including any fee charged or assessment made as a condition
of obtaining access to such public improvements, unless: (1) funds received
under section 106 of the Act are used to pay the proportion of such fee or
assessment that relates to the capital costs of such public improvements that are
financed from revenue sources other than under Title I the Act; or (2) for
purposes of assessing any amount against properties owned and occupied by
persons of moderate income, the grantee certifies to the Secretary that it lacks
sufficient funds received under section 106 of the Act to comply with the
requirements of subparagraph (1); and
(j) It will comply with the other provisions of the Act and with other applicable
laws.
