Any disclosable public records related to an open session item on a regular meeting agenda and distributed by the Clerk of the Board to a majority of the members of the Board of Supervisors less than 96 hours prior to that meeting are available for public inspection at 1025 Escobar Street, First Floor, Martinez, CA 94553, during normal business hours. All matters listed under CONSENT ITEMS are considered by the Board to be routine and will be enacted by one motion. There will be no separate discussion of these items unless requested by a member of the Board before the Board votes on the motion to adopt . Each member of the public will be allowed two minutes to comment on the entire consent agenda . Persons who wish to speak on matters set for PUBLIC HEARINGS will be heard when the Chair calls for public testimony. Each speaker during public testimony will be limited to two minutes. After public testimony, the hearing is closed and the matter is subject to discussion and action by the Board. Comments on matters listed on the agenda or otherwise within the purview of the Board of Supervisors can be submitted to the office of the Clerk of the Board via mail: Board of Supervisors, 1025 Escobar Street, First Floor, Martinez, CA 94553 or to clerkoftheboard@cob .cccounty.us. INTERVIEW two applicants (Danielle Madugo and Ciara Wood) to fill a vacant seat on the Kensington Fire Protection District Board of Directors; and 2. APPOINT an applicant (either Danielle Madugo or Ciara Wood) to fill the vacant seat for the remainder of the current term ending December 6, 2024. FISCAL IMPACT: No fiscal impact. BACKGROUND: Formed in 1937, the Kensington Fire Protection District (District) is an independent special district serving the 0.96 square mile unincorporated area of Kensington in West County - immediately adjacent to the cities of Richmond and El Cerrito as well as adjacent to portions of Alameda County. On December 11, 2023, the County received correspondence from the District requesting that the Board of Supervisors make an appointment to a vacant seat on the District Board of Directors no later than January 16, 2024 (Attachment A). The vacancy was due to the retirement of former Director Don Dommer on October 19, 2023. The County replied to the District’s correspondence on December 18, 2023 notifying the District that this matter would be taken up at a special meeting of the Board on January 11, 2024 (Attachment B). CONTRA COSTA COUNTY Printed on 1/16/2024Page 1 of 3 powered by Legistar™ File #:24-0137,Version:1 Appointment Process Under California Government Code Section 1780, if a vacancy occurs on a special district governing board, the district board may fill the vacancy either by appointment or by calling an election within 60 days after the effective date or notice of vacancy. In this case, the District had until December 17, 2023 to fill the vacancy either by appointment or by calling an election. After the vacancy occurred, the District conducted an application process and received two applications from interested residents for the vacant seat. On December 11, 2023, the District Board interviewed the two applicants during a special meeting but, ultimately, did not make an appointment or call an election at that time. The District subsequently requested that the Board of Supervisors make the appointment. If a special district board fails to appoint or call an election to fill a vacancy within 60 days, then the Board of Supervisors may fill the vacancy either by appointment or by ordering the special district to call an election, as long as the Board of Supervisors acts within 90 days after the effective date of the vacancy. In this case, the Board of Supervisors may fill the vacancy on the District Board if it does so by January 16, 2024. This seat will be up for election at the November 5, 2024 General Election. The new term begins at 12 noon on December 6, 2024, which is the first Friday in December following the General Election. Options for the Board to Consider The Board of Supervisors’ options include: 1.Appoint an individual to the vacant seat. The appointed individual would hold office until the term ending December 6, 2024. 2.Make no appointment and order an election. This option would require the District to call an election to fill the vacancy. 3.Take no action. If the Board takes no action, the District would be required by law to call an election to fill the vacancy. Application packets submitted by Danielle Madugo and Ciara Wood to the District for consideration have been included in today’s agenda packet for reference by the Board as Attachments C and D, respectively. In addition, the Clerk of the Board’s office has included all correspondence received related to this item in Attachment E for reference. Today’s action requests that the Board of Supervisors interview the two applicants and consider making an appointment to fill the vacant seat on the District Board of Directors. CONSEQUENCE OF NEGATIVE ACTION: Should the Board take no action at today’s meeting, then the Board will have until January 16, 2024 to make an appointment to the District Board or call an election to fill the vacancy. If the Board takes no action by January 16, 2024, then an election must be called to fill the vacancy pursuant to Government Code section 1780. After deliberation, two nomination ballots, and two motions, the results remain a tie between the two candidates; therefore, no appointment was made. The Board of Directors then voted unanimously to forward a request to the County Board of Supervisors to make this appointment. This District Board position became vacant on October 18, 2023, when Director Don Dommer retired. Pursuant to California Government Code section 1780(f)(1), if the vacancy is not filled by the Kensington District Board by appointment, or if the Kensington District Board has not called for an election within 60 days of the date the District Board is notified of the vacancy or the effective date of the vacancy, whichever is later, then the Board of Supervisors may (1) appoint a person to fill the vacancy within 90 days of the date the District Board is notified of the vacancy or the effective date of the vacancy, whichever is later, or (2) order the District to call an election to fill the vacancy. Since the Kensington District Board did not fill the vacancy by appointment, the statutory deadline for the Board of Supervisors to make an appointment to this vacant seat is January 16, 2024 (90 days following the vacancy date of October 18, 2023). Given the holiday season and the Board’s established 2024 meeting schedule, I have set a special meeting date of January 11, 2024 at 2:00 pm for the Board of Supervisors to take action on this appointment at the District’s request. This will ensure that the appointment is made prior to the statutory deadline of January 16, 2024. At its January 11, 2024 public meeting in Martinez, the Board of Supervisors will conduct public interviews of the two candidates who applied to fill the vacancy – Danielle Madugo and Ciara Wood. We will request the two applicants to be at the Board meeting in person. The County is not re-opening the application process. This meeting will be in hybrid format – the public may participate and provide input to the Board either in person at the meeting or through zoom or phone. The published Board agenda for this meeting will include the applications for appointment submitted by the two candidates. The public may also provide comments in advance of the meeting to the Clerk of the Board of Supervisors by emailing ClerkOfTheBoard@cob.cccounty.us. This is the same process the Board of Supervisors used to fill a recent vacancy on the Rodeo-Hercules Fire District Board. The individual appointed by the Board of Supervisors to fill this vacancy will serve through December 6, 2024. This seat will be up for election at the November 5, 2024 General Election. FISCAL IMPACT: Cost Savings. The increased compensation costs related to the interim placement of Captain Andreotti will be fully offset by cost savings from the vacancy in the Animal Services Director position. BACKGROUND: In November 2023, Animal Services Director Beth Ward notified the County Administrator of her intent to separate from County service effective January 19, 2024. Subsequent to that notification the County Administrator’s Office engaged Avery and Associates to conduct a nationwide executive recruitment to identify candidates. That recruitment is anticipated to launch within the coming weeks. The Animal Services Department organizational structure does not include a Chief Assistant or Deputy Animal Services Director, so there is no clear line of succession in instances where the Animal Services Director position becomes vacant. To ensure continuity of operations within the department, the County Administrator is recommending that the Board of Supervisors appoint Captain Jane De May Andreotti as the Interim Animal CONTRA COSTA COUNTY Printed on 1/16/2024Page 1 of 2 powered by Legistar™ File #:24-0138,Version:1 Services Director beginning on January 16, 2024 through the date of appointment of a permanent Animal Services Director. Ms. Ward’s last day in the office will be January 15, 2024, for this reason it is important to make this interim appointment prior to her separation date of January 19, 2023 to maintain continuity of operations within the department. Captain Andreotti has indicated that she will not be a candidate for permanent appointment to the Animal Services Director position. Captain Jane De May Andreotti has over 30 years of public sector experience beginning in the 1980s in the City of Berkeley. In 1996, she was hired by the City of Walnut Creek Police Department and served in several capacities, including patrol, hostage negotiation, field training officer and narcotic K-9 handler. In 2009, Captain Andreotti joined Contra Costa Animal Services rising through the ranks of Sergeant, Lieutenant and ultimately was appointed Captain of Field Services in 2016 - the highest peace officer position in the department. Captain Andreotti’s wealth of experience, progressive ascension through the ranks within multiple public service agencies and love of animals makes her the perfect candidate for the role of Interim Animal Services Director. Captain Andreotti remains committed to maintaining stable operations during the executive recruitment process. CONSEQUENCE OF NEGATIVE ACTION: If the Board of Supervisors does not appoint an Interim Animal Services Director to serve in a temporary capacity following the departure of Ms. Ward, then the department head position will remain vacant until the Board appoints a permanent Animal Services Director.
