HomeMy WebLinkAboutMINUTES - 02241987 - 1.47 WI / f7 /U_ vr �- To A BOARD OF SUPERVISORS FROM: Phil Batchelor Contra County Administrator Costa DATE' February 17, 1987 County SUBJECT: ' "y Legislation: Senate Bill 349 (Bergeson) SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION: Adopt a position of support for SB 349 by Senator Marian Bergeson which would allow Contra Costa County, and other named counties, to increase the additional penalty assessment for every non-parking offense from $1 . 00 per $10. 00 of fine to $2. 00 per $10. 00 of fine, and would allow the imposition of a $1. 50 surcharge on the fines and forfeitures collected for each parking offense. These added penalty assessments and surcharges on fines and forfeitures would be deposited in the County Courthouse Temporary Construction Fund. In addition, SB 349 authorizes an increase from $1 to $2 per $10 of fine for non-parking offenses to be deposited to the Criminal Justice Temporary Construction Fund. BACKGROUND: Under current law, Contra Costa County has a County Courthouse Temporary Construction Fund. This fund receives a .$1.00 penalty assessment for each $10. 00 of non-parking offenses. Senator Bergeson, at the request of the Board of Supervisors, has introduced SB 349, which would increase- this penalty assessment on non-parking offenses from $1. 00 to $2 . 00 for each $10. 00 in fines and forfeitures. In addition, SB 349 authorizes Contra . Costa County, and other named counties, to deposit $1 . 50 for each parking case presented to or filed in the courts of the county in the Courthouse Temporary Construction Fund. In addition, the County has a Criminal Justice Temporary Construction Fund which already receives the $1.00 penalty assessment for each $10. 00 of fine on non-parking offenses plus funds from the $1. 50 for parking offenses. SB 349 would increase the amount for non-parking offenses to $2 . 00 . Since Senator Bergeson has introduced SB 349 and included Contra Costa in its provisions, it is appropriate for the Board to indicate its support of SB 349. Passage of SB 349 would increase deposits to the Courthouse Construction Fund by $1. 2 million annually.
