HomeMy WebLinkAboutMINUTES - 02241987 - 1.46 1-046 To- BOARD OF SUPERVISORS FROM: Phil Batchelor Contra County Administrator Costa DATE: February 17 , 1987 County SUBJECT: Legislation: Senate Bill 330 (Robbins) SPECIFIC REQUEST(S) OR RECOMMENDATION(_S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION• Adopt a position of support for SB 330 by Senator Robbins which would extend to any county the authority San Diego and Alameda counties now have to impose an administrative fee for the cost of recording and maintaining a record of the defendant' s prior convictions for violations of the Vehicle Code, and for notifying the Department of Motor Vehicles that a defendant' s driver' s license or automobile registration is attached, or restricted. SB 330 would also authorize any county to establish a fee in both municipal and superior court for the cost of processing accounts receivable for fines owed in criminal cases. BACKGROUND: Under current law, only Alameda and San Diego counties have this authority to impose the administrative assessment for DMV notification and to impose a fee for accounts receivable. Last year, Senator Petris carried SB 1740 which provided this. authorization for Alameda County. We had initially asked that Contra Costa County be added to SB 1740 . So many counties asked to be added to SB 1740 that Senator Petris amended the bill to include any county. The bill later had to be amended back to only Alameda County. It had been Senator Petris' intent to leave Contra Costa County in the bill. Through an error, our County was left out so that the final bill added only Alameda County. This year we have asked Senator Robbins to carry legislation similar to last year' s SB 1740 and again expand it to include all counties. The result is SB 330. The administrative fee for DMV records and notification could not exceed $10, and the fee for processing accounts receivable in municipal and superior courts for criminal fines could not exceed $30. It is estimated that passage of SB 330 would generate additional revenue in the County of $300, 000 per year. Passage of this legislation is a part of the Board' s 1987 Legislative Program. We are, therefore, recommending that the Board support SB 330.
