WHEREAS, Section 99.1 of the Revenue and Taxation Code provides
that a jurisdiction~l ·change resulting from a special district
providing one or more services to an area .where such services have
not been previously provided shall not become effective if one or
.more affected special distr i cts involved in the property tax
exchange negotiation fails to adopt a resolution agreeing to a
transfer; and
WHEREAS, the Board of Supervisors shall determine the property
tax exchange for each affected district that fails to adopt a
resolution agreeing to a property tax transfer except for the
annexing district; and
WHEREAS, annexations 247 through 255 to West Contra Costa
Sanitary District (LAFC 81-33, 80-42, 81-36, 81-37, 81-38, 81-84,
81-85, 82-20, and 82-19, respectively ) propose annexation of
te r ritory which results in provisions of services not previously
provided and no resolutions have been adopted agree i ng to property
tax exchanges; and
THEREFORE, BE IT BY THE BOARD OF SUPERVISORS OF CONTRA COSTA
COUNTY RESOLVED that the property tax incre-ment allocation f actors
f or the a ffected agencies i n the area of annex ations 247 throug h
255, to West Contra Costa Sanitary District (LAF C 81-33, 80-4 2 ,
81-36, 81-37, 81-38, 81~84 , 81-85, 82-20, and 82-29, respectively)
for the 1983-1984 fiscal year and subsequent years shall be as
shown on the attached schedule . Said increment tax allocation
factors apply to affected terr i tory as submitted or revised b y the
Loc al Agency Formation Comm i ss i on.
Th is resolution do es no t change t h e property tax re v e nues
accrui ng to other agencies serving the subject terr i tory or the
affected districts' right to collect tax es fo r existing bonded
indebtedness.
