SUBJECT: CONFIRM AND CLARIFY THE DISTRICT GEOLOGIST'S STATUS AS STAFF EMPLOYED BY THE BLACKHAWK
GEOLOGIC HAZARD ABATEMENT DISTRICT. (W.O. 5147)
Specific Requests or Recommendation(s) Background justification
I. RECOMMENDED ACTION:
It is recommended that the board act on the following:
1. Authorize the General Manager Richard A. Nystrom to employ a staff and confirm the status
of John W. LaViolette as the District Geologist and of William Scott as his assistant
with a budgetary limit of $70,000.
2. Inform the Auditor-Controller that the District's construction contract limitation of
$20,000 and the District' s consulting services contract limitation of $5,000 do not apply
to the District Geologist and his assistant, and that prior Board approval is not required
for payment warrants to the District Geologist and his assistant which may exceed the
above limits.

III. REASONS FOR RECOMMENDATION/BACKGROUND:
On June 24, 1986 (Board Resolution No. 86/369) the County Board of Supervisors, as the Board
of Directors for the Blackhawk Geologic Hazard Abatement District, authorized the employment
of Richard A. Nystrom as General Manager of the G.H.A.D. to manage and direct the day-to-day
operations and staff of the District and to perform such other duties as the Board may from
time to time designate. Board Resolution No. 86/371 approved the 1986-1987 G.H.A.D. budget
establishing budgetary allowances of $50,000 for the General Manager and $70,000 for a District
Geologist .and his assistant. These positions were intended to constitute the permanent on-
going staff of the G.H.A.D.
The Board of Directors further authorized the General Manager to execute construction contracts
for sl ide repair work up to $20,000 and to execute consulting services contracts with consulting
soils engineers for up to $5,000 without prior Board Approval .
The County Auditor-Controller is requesting clarification and confirmation of the District
Geologist's status as staff with a budgetary limit of $70,000, and that the construction contract
limitation of $20,000 and the consulting services contract limitation of $5,000 does not apply
to payment warrants made to the District Geologist.
IV. CONSEQUENCES OF NEGATIVE ACTION:
Payment to the District Geologist and his assistant will be withheld pending verification of
their staff status:
