SUBJECT: Legislation: Assembly Bill 339 ( Cortese)
SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Adopt a position of opposition to AB 339 by Assemblyman Dominic
Cortese unless an offsetting revenue source is identified which
will fully reimburse the County for the property tax revenue
which would be transferred to the no-property tax cities and
low-property tax cities in the County by AB 339.
BACKGROUND:
AB 339 has been introduced by Assemblyman Dominic Cortese. It
would do two things:
1 . provide cities which imposed no property tax in the
1977-78 fiscal year a property tax equal to 10 cents
per $100 of assessed value; and
2 . provide cities which imposed a property tax which in
the 1987-88 fiscal year is equivalent to less than 10
cents per $100 of assessed value, an amount of property
tax which would bring the city up to 10 cents per $100
of assessed value.
The property tax allocated to these cities would be taken 100%
from the County' s property tax, thus holding harmless other
cities, school districts,' 'and special districts. Contra Costa
County, of course, has two "no-property tax cities" : Lafayette
and Pleasant Hill. There are also some cities which fall into
the "low property tax city" category. The Auditor-Controller is
still checking to verify the exact number of such cities and the
total cost of the bill to this County.
Assemblyman Cortese has been quoted as saying he will not move AB
339 unless he can identify an offsetting revenue source which
will fully reimburse the County for the loss of property tax
revenue.

AB 339, in the absence of such a permanent guarantee of an
offsetting revenue source, is totally unfair to counties. The
bill might be more equitable if it reduced the property tax
allocation to the schools, other cities, and special districts
proportionately in order to provide increased property tax
revenue to the no-property tax and low property tax cities.
However, taking 1000 of the property tax transfer from the County
is entirely unacceptable.
It is, therefore, recommended that the Board oppose AB 339 unless
it is amended to provide a permanent source of offsetting revenue
to the County which will grow at approximately the same rate as
the property tax does. In the absence of such a guarantee, the
Board should totally oppose AB 339.
