SUBJECT:
STATUS REPORT ON AREA OF BENEFIT FEE ISSUE
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
1. Consider the Committee' s recommendation that the Board establish a
policy that no fee shall be imposed upon new development as a
condition of approval unless such fee has been established by
ordinance.
2 . Direct the Public Works Department to establish an accounting system
to identify the amount and use of new developer fees collected by the
County for Area of Benefits with* presentation of that information
during the budget development sessions of 1988 .
3 . Direct the Public Works Department to present status reports to the
Board by its second meeting of January 1988 on a draft fee ordinance
for County Area of Benefits, and by its third meeting of January 1988,
a report on present County Area of Benefits fees collected with
intended projects and an accounting of the present balance of those
fees collected.
REASONS FOR RECOMMENDATION:
Earlier this year, the Board requested the County Administrator' s Office to
prepare a report regarding the amount and use of development fees collected
by the County.
On August 4, 1987, at the request of Supervisor Schroder, the Board
referred to the Finance Committee the issue of the need for a Board policy
regarding fees on new development..
On .September 21, 1987, the Finance Committee met to consider the above
issues. The Finance Committee discussed Supervisor Schroder' s suggestion
that no. new development fees be imposed as a condition of approval unless
the fees have been established by ordinance. The Committee also discussed
the need for coordination between the departments involved in the
development process in regard to establishing development fees.
The County Administrator' s Office presented information regarding various
fees which indicate the dollar amount of the fees and the purpose for which

the fees were being collected. However, it was felt that the information
should be provided in a slightly different format that would show the total
amount of money needed to fund the project for which the money is being
collected and the amount toward that end that has been collected as of a
certain date.
On November 20, another presentation was made to the Finance Committee
which sought approval for a resolution that would establish a minimum level
of mitigation for new development. While the Committee agreed that new
development should, as far as possible, pay its own way for benefits
received, any new fees must follow the flavor of the Board' s policy on
establishing fee ordinances.
The Committee instructed staff of the Community. Development and Public
Works Departments to collaborate and circulate to the Board members a draft
ordinance which sets forth a fee schedule for new development assessments
in the Area of Benefits. The Committee also asked for an accounting of
present Area of Benefits that have been collected, project use and present
balances with anticipated timelines for completion of current projects. A
report on the ordinance' s status should be made to Board at its second
meeting of January 1988 and on the accounting of fees collected in County
Area of Benefits at its third meeting of January 1988.
