SUBJECT: Landfill Development Agreement Fees
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION .
RECOMMENDATION
1. State the Board' s intention thatthe litter/illegal dumping
cleanup, enforcement and prosecution programs included in
the development agreement be countywide to include all
cities which are willing to participate.
2. Request staff to further investigate the cost of rate review
at new landfills.
3. Delay scheduling Board of Supervisors consideration of
approval of the land use permit until January 12, 1988 .
4. State the Board' s intention that the development agreements
should be fully negotiated and ready for Board approval
before or at the same time the land use permits for sanitary
landfills are being considered before the Board.

REASONS FOR RECOMMENDATION/BACKGROUND
At the November 24 , 1987, meeting of the Finance Committee, staff
presented a memorandum describing the programs and the fees asso-
ciated with special conditions and development agreements for new
landfills. The memorandum included the following programs: rate
review, litter/illegal dumping cleanup, litter/illegal dumping
enforcement, litter/illegal dumping prosecution, public educa-
tion, abandoned vehicles, Solid waste Program Manager, Resource
Recovery Manager, solid waste planning, solid waste enforcement,
Geotechnical Inspector, and Landfill Development Coordinator.
Included in the memorandum was information as to how the special
conditions for landfill approval reviewed by the Board on Novem-
ber 3 , 1987, would be incorporated into the development agreement
or the land use permit conditions of approval. Annotated versions

of the conditions of approval for the East Contra Costa Sanitary
Landfill and the Kirker Pass waste Management Landfill were
presented showing changes suggested by the Board, Planning Comm-
ission and staff. staff has attempted to make both conditions of
approval consistent with each other, the Acme Fill Transfer
Station proposed conditions of approval, and the Solid waste
Management Plan.
In reviewing the development agreement programs and fees, the
Committee felt that all activities concerning litter/illegal
dumping should include service to incorporated cities if they
desire that service. It is appropriate for staff to further
discuss this with the General Services Department, Sheriff ' s
Department and the District Attorney to determine the additional
cost and/or procedures for implementing this program countywide,
including cities. The Committee also felt that the cost for rate
review may be underestimated and requested staff to further
investigate this matter.
Board consideration of the land use permit for the East Contra
Costa and Kirker Pass Landfills had been scheduled for December
15, 1987. Since staff was not expecting to have the issue of
the development agreement referred to the Finance Committee,
staff has been unable to commence or complete negotiations with
the applicants on the development agreement. The Committee
suggests that the Board delay action on the land use permit until
January 11, 1987 . The Committee also recommends that the
development agreement be fully negotiated and ready for Board
execution on that date, to be considered along with the land use
permit.
