APPROVING CONSULTING SERVICES AGREEMENT FOR E
SUBJECT: ARCHITECTURAL SERVICES FOR MAGEE PARR MASTER PLAN, DANVILLE
AND ALAMO (WPE472)
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
I. RECOMMENDED ACTION
A. APPROVE a consulting services agreement with David L. Gates
& Associates, 244 Tassajara Lane, Danville, for landscape
architectural services for a Master Plan for Magee Park,
North end of La Gonda Way, Danville and Alamo.
B. AUTHORIZE the Director of General Services to execute the
agreement and to issue written authorizations for extra
work, provided that the cumulative total extra cost for all
such authorizations shall not exceed $25, 000. 00. The
agreement will be effective December 1, 1987 and will
provide for master plan services, with a payment limit of
$39, 000. 00, which amount shall not be exceeded without
prior,, written authorization by the Director of General
Services.
II. FINANCIAL IMPACT.
This agreement will be funded by equal financial contribution
from the County and from the Town of Danville.
III. REASONS FOR RECOMMENDATIONS/BACKGROUND.
A. On May 14, 1987 , the Board approved a Joint Powers
Agreement with the Town of Danville for maintenance and
operation of the proposed Magee Park for County Service
Area R7-A. The agreement created a Joint Planning and
Operations Committee with representation from the Town and
the County Service Area. Under the agreement, one of the
duties of the Committee is to prepare a master plan for
future development of the site.
B. Subsequently, the Community Development Department
solicited proposals from 19 recommended landscape design
and planning firms. On August 31, 1987, the County
received eight proposals. A selection committee
representing the Joint Planning and Operations Committee

reviewed the proposals and invited six of the most
qualified firms to interviews, held on October 1, 1987 .
The selection committee included representatives from the
Town of Danville, Service Area R7-A, and the County
Community Development and General Services Departments.
C. On November 10, 1987, the Board authorized the Director of
General Services, on behalf of the Joint Planning and
Operations Committee, to negotiate an appropriate agreement
with the landscape architectural firm ranked first by the
selection committee. The negotiations have been completed
and an appropriate agreement is ready to sign.
D. The Consultant is 50% owned by females; 10% of the
professionals employed by the firm are minorities, 70% of
the professionals are female.
E. The County must proceed with this agreement for landscape
architectural services because it does not have staff to
provide the services.
IV. CONSEQUENCES OF NEGATIVE ACTION
Under the terms of the Joint Powers Agreement with the Town of
Danville, the County has agreed to proceed with this project as
soon as possible. If this recommendation is not approved, the
County will delay the project.
