Recommended Action: APPROVE Amendment to Right of Way Contract dated November 1, 1987 from Richard J. Borke and Georgina Borke. AUTHORIZE Chief Engineer to execute said Amendment to Right of Way Contract on behalf of the District. APPROVE payment of $440. 00 for said Amendment to Right of Way Contract and AUTHORIZE the Auditor-Controller to issue a check in said amount payable to Richard J. Borke and Georgina Borke to be forwarded to the Real Property Division for delivery. Accounting II. Financial Impact: Payment of $440. 00 from Upper Pine Creek Flood Control Zone 3B funds which are 75% reimbursable from State Department of Water Resources. III. Reasons for Recommendations and Background: On September 15, 1987 this Board approved a Right of Way Contract with the Borkes, which provided for a Temporary Construction Permit and the removal of certain improvements and landscaping from the Borke' s property. Subsequent to that agreement, the District' s contractor removed two trees that were not included in the agreement. The two additional trees have been valued at $440. 00. IV.
