SUBJECT: (Delta Wetlands Project)
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION
1. Submit Fish and Wildlife Study Committee questions and con-
cerns pertaining to fish and wildlife impacts of project
during EIR scoping session.
1 . Submit questions and concerns of the County Flood Control
p District over the proposed design, construction and stabili-
ty of interior project levees during EIR scoping session.
i . Direct County Counsel to provide answers to the following
questions:
A. Does the conversion of Delta islands from traditional
agricultural uses to a seasonal water storage reservoir
require the application and issuance of a General Plan
amendment and/or a land use permit?
B. Does the answer to the above change if commercial hunt-
ing clubs are involved?
C. In addition to the above, if the hunting club proposal
involves splitting of the property so as to convey in
some fashion property rights in specific areas and
installation of improvements such as boat facilities,
club house, portable sanitary facilities, etc. , will
this result in the necessity to process the proposal as
a subdivision?

BACKGROUND
The Committee reviewed the minutes of the November 5 , 1987, meet-
ing of the Fish and Wildlife Study Committee and felt that the
questions raised by the Study Committee concerning the proposed
project should be formally submitted during the EIR scoping ses-
sions. A representative from the County Flood Control District
was also present at the November 5th Fish and Wildlife Study
Committee meeting. It was reported to the Water Committee that
Flood Control has several concerns pertaining to the proposed
design of the interior levees or "beach slopes. " These concerns
include the stability of the levee foundations after construction
and the possibility of the levees becoming buoyant during the
deep flooding phases of the project. The Committee believes that
the questions raised at the November 30 Water Committee meeting,
and stated above, should be addressed by County Counsel at this
point in time.
