1988 Legislative Program
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGRWND AND JUSTIFICATION
RECOMMENDATIONS:
1. Adopt the attached as the Board' s 1988 Legislative Program.
2 . Authorize the County , Administrator to work with the County
Supervisors ' Association of California (CSAC) and other
affiliated professional associations in support of the
Board' s Legislative Program.
3 . Authorize the County Administrator to seek authors for and
work with the County' s legislative advocate in Sacramento in
support of the Board' s Legislative Program..
BACKGROUND:.
Each year the Board seeks suggestions from County Departments for
items which should be .included in its annual Legislative- Program.
In addition, the Board identifies items during the year which it
wishes to include in its Legislative Program. Those items have
been consolidated in the attached proposed 1988 Legislative
Program. Some of these issues will be included as a part of the
Board' s contract with the County' s legislative advocate and will
form the basis of their work plan for 1988. Other items will be
pursued separately by the County without requesting assistance
from the legislative advocate. Other items will be ones the
Board supports, but for which the Board relies on CSAC and other
professional associations to provide the major advocacy.
. The attached proposed 1988 Legislative Program does not include
one major area of interest, that . of transportation issues. The
Board contracts separately with another legislative advocate for
transportation advocacy. The work plan which forms a part of
that contract' needs to be added to the attached in order to
complete the Board' s '1988 Legislative Program. In addition,
throughout the Legislative Session the Board takes positions on
various pieces of legislation which, in effect, modify and add to
the Board' s Legislative Program.

..voters in the November 4, 1987 election, and a position in support of the concepts of.

1988 LEGISLATIVE PROGRAM
1 . Amendments to SB 709 to address the no- and low-property tax
city issue.
2. Amendments to SB 709 to clean up the Trial Court Block Grant
portion of the bill.
3 . Legislation to restore the Board of Supervisors ' ability to
place special tax measures on the ballot.
4. Sponsor a municipal court pay and staffing bill to reflect
changes in pay and staffing which have been approved during
the 1987-88 fiscal year. This bill, or separate
legislation, will also be required to implement the
agreement on the Marshal/Sheriff consolidation and the
consolidation of the administration of the Municipal Courts.
5 . Support the passage of AB 145 (Speier) and AB 558 (Hannigan)
which would each provide pilot projects to increase the
level of services to the homeless (AB 145) and foster care
services (AB 558 ) , providing Contra Costa County is made one
of the pilot projects.
6 . Legislation to require that a Redevelopment Agency
pass-through to fire districts, and possibly other taxing
agencies which are impacted by redevelopment, a portion of
the tax increment which would have gone to the taxing agency
had the redevelopment agency not existed.
7 . Legislation to change the split of sales tax revenue and
fines and forfeitures between the cities and the county in
cases of new incorporations unless SB 709 is amended to
relieve the county of the transfer of property taxes.
8. Oppose any efforts to include existing fire districts in
procedures enacted pursuant to SB 515 of 1987 which makes it
easier to change the governing board of a fire district.
9 . Legislation to clarify that when a previously "dependent"
special district becomes "independent" its contribution to
the Special District Augmentation Fund is frozen at the
level of contribution made during the last full fiscal year
the "dependent" district was in existence rather than being
frozen at the 1983-1984 level.

10. Legislation to intensify the enforcement of vehicle
registration laws, particularly pertaining to the
registration of out-of-state vehicles to insure that
vehicles which ought to be registered in California are.
(Specific details to be developed in discussions with the
CHP) .
11. Legislation to extend or waive the current two-year limit on
time to hear and decide an assessment appeal when the Board
of Supervisors by a 4/5 vote makes the following findings:
a. The assessment appeal has been filed by an industrial
or commercial property owner, rather than a residential
property owner.
b. The assessment appeal is unusually complex and involves
the appeal of at least three year' s assessments.
C. There is no evidence that the County has unduly delayed
processing the assessment appeal.
d. Equity to the property taxpayers of the county requires
that the two-year limit be extended by one or more
years in order to properly complete the appeal process.
12 . Legislation which would improve the county' s ability to
prosecute instances of intentional illegal dumping of
hazardous materials or hazardous wastes as felonies, or to
otherwise increase the ability of the County to impose
substantial fines for such illegal dumping, to the extent
that such legislation is deemed necessary.
13 . Legislation which would allow the Board of Supervisors, upon
making a finding that an audit or investigation of the
finances of an independent special district is justified
based on a preliminary review made by either the County
Administrator or County Auditor of a complaint filed with
the Board of Supervisors, to order such an audit or
investigation and to require that the independent special
district bear the reasonable costs of the audit or
investigation.
14 . Support efforts to provide a stable source of revenue for
local governments.

15 . Support efforts to provide a transfer of State revenue to
local government prior to rebating further revenue to the
taxpayers.
16. Support efforts to strengthen the requirement that the State
fully fund mandates on local government.
17 . Legislation which would amend SB 501 (Chapter 244 , Statutes
of 1981) to insure that the County will be able to continue
to impose the current 10% tax on the IT Corporation facility
in Martinez even if as a result of modernization currently
being planned the facility no longer requires a permit as a
Class 1 hazardous waste disposal facility, but does receive
and treat hazardous waste on-site for subsequent disposal at
another location.
18 . Legislation which would permit the release of AIDS test
results to the Probation Department and Superior Court in
cases where a minor is a ward of the court and is in the
custody of the Probation Officer or is in placement in a
residential program under the supervision of the Probation
Officer.
19 . Legislation to limit the number of State agencies which have
jurisdiction over the Contra Costa Health Plan to only one,
whereas currently the State Department of Corporations and
the State Department of Health Services both have such
jurisdiction.
20 . Support legislation designed to increase funding to
Veterans ' Service Officers (AB 148) .
21. Provide rate increases for community living facilities for
developmentally disabled persons similar to AB 150 of the
1987 Session which was vetoed by the Governor.
22. Legislation which authorizes Boards of Supervisors to offer
property tax relief to nursing homes that agree to provide a
specified number of their beds for Medi-Cal patients for a
fixed number of years and which authorizes the Franchise Tax
Board to offer similar State Income Tax credits and State
Bank and Corporation Tax credits upon a finding that a
nursing home owner has agreed to make specified number of
nursing home beds available to Medi-Cal patients.

23 . Legislation to provide for higher Medi-Cal reimbursement
rates for skilled nursing facilities which enter into an
agreement with the county or the State to accept their fair
share of Medi-Cal patients for at least a five-year period.
24 . Legislation which would authorize counties and cities to
require skilled nursing facilities to accept Medi-Cal
patients for at least 20 years as a condition of approval of
a land use permit.
25. Legislation which would authorize the State Administration
to increase reimbursement rates for skilled nursing
facilities based on quality of care performance standards
for those institutions willing to continue to accept new
Medi-Cal patients.
26 . Legislation which would provide an additional "bonus
payment" to skilled nursing facilities which are
disproportionate providers, or which are willing to take
greater than their "fair share" of Medi-Cal patients.
27 . Determine what incentives are necessary to encourage wider
availability of long-term care insurance in the private
sector.
28. Explore the feasibility of State-sponsored, long-term care
insurance programs, including tax exemptions for
contributions to a long-term care plan.
29 . Ensure through regulations and financial incentives that
alternatives to skilled nursing facilities (adult day health
care, home care, in-home supportive services, etc. ) are
viable care options in a long-term care insurance plan.
30 . Encourage the State Department of Health Services to enforce
long-term care facility regulations without being
excessively punitive to long-term care facility operators to
the extent that they are discouraged from accepting Medi-Cal
patients.
31 . Legislation, if required, to allow the Contra Costa Health
Plan to sponsor a long-term care insurance plan.
