HomeMy WebLinkAboutMINUTES - 12082015 - C.63RECOMMENDATION(S): APPROVE AND AUTHORIZE the Auditor-Controller, or his designee, to pay $22,322 to UHS Surgical Services, Inc. for the provision of surgical lasers, equipment and certified technicians to the Surgical Unit at Contra Costa Regional Medical Center (CCRMC) during the period March 1, 2015 through August 31, 2015. FISCAL IMPACT: This contract is funded 100% Hospital Enterprise Fund I. BACKGROUND: UHS Surgical Services, Inc. has been providing laser and other surgical equipment as well as trained and certified technicians to CCRMC for several years pursuant to a blanket purchase order. Due to the change from purchase order to contract, the provider has not been paid in full for prior services. The provider is entitled to payment for the reasonable value of its services under the equitable relief theory of quantum meruit. That theory provides that where a person has been asked to provide services without a valid contract, and the provider does so to the benefit of the recipient, the provider is entitled to recover the reasonable value of those services. Here, UHS Surgical Services, Inc. provided services at the request of the department after the purchase order expired but before the contract began. The Division is requesting the amount due the Contractor be paid the amount owing of $22,322.
