Spooner , Contracts Administrator Costa DATE: December 3, 1987 CO^ SUBJECT: Approval of FY 1987-88 Novation Contract #24-238-12 with ��•• Mental Health Consumer Concerns , Inc. to provide Patients ' Rights Advnrary and Cliant Salf—Hale Sarcinae SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION I . RECOMMENDED ACTION : Approve and authorize the Chair to execute on behalf of the County, Novation Contract #24-238-12 with Mental Health Consumer Concerns , Inc. in the amount of $115 , 276 for the period July 1 , 1987 through June 30 , 1988 for provision of patients ' rights advocacy services , including representation at "Doe-Gallinot" Certification Review Hearings , and client self-help services . This document includes a six-month automatic contract extension from June 30 , 1988 through December 31 , 1988 in the amount of $57 , 638. II . FINANCIAL IMPACT : This contract is fully funded in the Health Services Department Budget for 1987-88 (org . #5942) , including a budget augmen- tation which was provided by the Board of Supervisqrs for insur- ance and program cost increases . The Contract Payment Limit is funded 100% by County funding . Although this is a State-mandated service under AB 3454 , the State has not provided funding for the Certification Review Hearing Services and , therefore , it is currently funded entirely by County funds . Our attempts to obtain State reimbursement under SB 90 for the AB 3454 mandated Certification Review Hearing Services have thus far been unsuccessful . III . REASONS FOR RECOMMENDATIONS/BACKGROUND: This contractor has been providing these patients ' rights and client self-help services under an automatic extension of the FY 1986-87 Contract #24-238-11 and #24-360-1 . Novation Contract #24-238-12 replaces the six-month automatic extension under the prior contracts #24-238-11 and #24-360-1 . Each involuntarily detained patient and each voluntary patient admitted to a facility designated for psychiatric treatment and evaluation has the right "to see and receive the services of a patient advocate who has no direct or indirect clinical or administrative responsibility for the person receiving mental health services" pursuant to Welfare and Institutions Code , Section 5325h. 2 . The duties of the Patients ' /Residents ' Advocate as enu- merated in California Administrative Code , Title 99 Section 863 . 2 are : ( a) Ensure that the rights listed in Section 5325 of the Welfare and Institutions Code and in Section 861 remain posted in all facilities where posting is required pursuant to Section 860 . ( b) Ensure that all incoming patients/residents are notified of these rights . ( c) Assist in training staff of facilities specified in Section 860 regarding patients ' /residents ' rights . (d) Investigate complaints of patients/residents or their responsible relatives , and if necessary, act as advocate for patients/residents . ( e) Act as advocate in behalf of patients/residents who are unable to register a complaint because of their mental or physical condition. ( f) Act as local consultant in the area of patients ' /residents ' rights . ( g) Act as liaison to the Patient Rights Specialist of the State Department of Mental Health. 3 . Patient representation at 14 Day Certification Review Hearings pursuant to the Doe v. Gallinot decision.
