HomeMy WebLinkAboutMINUTES - 12082015 - C.01RECOMMENDATION(S): APPROVE and AUTHORIZE the Public Works Director, or designee, to execute a Right of Entry Agreement with Union Pacific Railroad Company for Camino Diablo paving at the UP crossing, and APPROVE payment of $750 for Marsh USA's Railroad Protective Liability Insurance, Byron area. FISCAL IMPACT: The Camino Diablo paving will be funded by Local Road funds (100%) BACKGROUND: This agreement is required to allow the County to work within 25 feet of Union Pacific Railroad Company's (UP) railroad tracks. As a condition of the Right of Entry Agreement, UP has required the County to indemnify UP and the indemnification language has been reviewed by County Risk Management. CONSEQUENCE OF NEGATIVE ACTION: The Public Works Department will not have sufficient access rights to allow needed maintenance to be performed at this location.
