D. 2 PUBLIC COMMENT (3 Minutes/Speaker)
Scott Hutchison, county employee, spoke on healthcare issues in bargaining;
Michael Floyd, Public Employees' Union Local 1, requested the Board give consideration to the
pay equity study, especially in light of the rising cost of living in Contra Costa and the specter of
people choosing to work in other counties;
Corinne Tate, co-founder No Kill Contra Costa, said that the majority of other counties run no-
kill animal shelters and mentioned that some animals are euthanized because family's cannot
pay the fees to reclaim their pet;
Louise McGuire, resident of Concord, asked the Board for direction on pursuing the possibility
of changing the name of Kirker Pass Road, Kirker Pass Creek and Kirker Pass to a name
chosen by the Ohlone tribe of the San Francisco area, because she has recently learned that the
individual the areas are named after had a questionable past (the Public Works Director will
assist Ms. McGuire);
Judy Mena, resident of Danville, recounted a dissatisfactory experience at the animal shelter
(District II staff will meet with Ms. Mena);
Julie Linford, Outcast Cat Help, reports the organization has rescued over 400 cats in Contra
Costa, and spoke of impound and boarding fees being assessed to the rescue organizations that
animals are microchipped to. Ms. Linford requested a cease and desist policy in writing by the
weekend;
Willie Mims, resident of Pittsburg, said he did not feel the revised resolution adopted in item
D.3 was appropriate under the Brown Act, and commended Chair Gioia for his dissenting vote
on said item;
Mister Phillips, resident of Richmond, stated his opinion that the Item D.3 revised version of the
resolution had been prepared far in advance of the meeting, and should have been available to
the public before the meeting. He requested the matter be rescheduled on another agenda.
County Counsel reported there had been no violation of the Brown Act.
D.3 CONSIDER adopting Resolution No. 2015/301, approving the County’s proposal to be awarded $80 million in
State financing for the West Contra Costa County Reentry, Treatment, and Housing facility project in the
Richmond area, authorizing the Sheriff to submit the proposal to the State, and taking related actions, as

The following people did not speak but left written comments for the Board's consideration

Chair Gioia expressed deep concerns regarding the availability of the local matching funds
designated in the resolution and the ongoing funding should the project go forward. He said he
believes the cost is higher than what is estimated and will certainly rise over time, especially
with salary bargaining with the Sheriff's deputies staffing the facility. He is concerned that
where the money will come from is not defined. He said he is not comfortable being unable to
guarantee that the dollars for high-level program services will be there. He further felt that the
citizens would prefer more beat officers in the community than a new facility. For these reasons
he is unable to support the project.
Resolution 2015/301 contains a paragraph in regard to appropriating a local match in funds,
which requires a 4/5 vote. It being apparent this threshold cannot be met, staff provided a
Revised Resolution 2015/301 without that stipulation. Supervisor Mitchoff reminded the Board
and public that not having that clause meant a loss of 12 points in the scoring total for Contra
Costa's application, placing us at a disadvantage in competing for the grant.
Having heard from the public and discussing the matter, the Board:
RECEIVED a presentation and report from the Sheriff's Office on the status of the proposed
West Contra Costa County Reentry, Treatment and Housing (“WRTH”) facility project and the
Senate Bill 863 Request for Proposal (“RFP”) process;
ADOPTED the Revised Resolution No. 2015/301, approving the County’s proposal for SB 863
financing for the WRTH facility project (the “Proposal”), authorizing the Sheriff-Coroner to
sign and submit the Proposal to the Board of State and Community Corrections, approving the
forms of the project documents deemed necessary by the state, and authorizing the appropriate
signatories to execute those documents at the appropriate times;
APPROVED and AUTHORIZED the Sheriff-Coroner and County Administrator to make non-
substantive edits to the Proposal and its attachments prior to submission to the Board of State
and Community Corrections (“BSCC”), and to correct any technical deficiencies requested by
the BSCC following submission.

D.5 HEARING to consider a reversion to acreage of subdivision SD04-08920 and finding of exemption
under the California Environmental Quality Act, as recommended by the Public Works Director, El
Sobrante area. (100% Developer Fees and Settlement Funds) (Warren Lai, Public Works
Department)
Speakers: Dan Shaw, 1486 Investors, Inc. thanked the Board for the additional time and staff
for exemplary assistance. Mr. Shaw hopes to return with a new project soon.
CLOSED the public hearing. ADOPTED conditions for reversion to acreage as set forth in
Government Code section 66499.17, subdivisions (b)-(c). ADOPTED Resolution No. 2015/292
approving the final map of the reversion; FOUND that the reversion to acreage of SD04-08929
is exempt from review under the California Environmental Quality Act (CEQA; DIRECTED
the Conservation and Development Director, or designee, to file a Notice of Exemption with the
County Clerk, and DIRECTED the Public Works Director, or designee, to arrange for payment
of the $50 filing fee to the County Clerk; DIRECTED the Clerk of the Board to execute a
Notice of Reversion to Acreage; and DIRECTED the Public Works Director, or designee, to
arrange for its recording concurrently with the final map; ADOPTED reversion to acreage
findings as set forth in Government Code section 66499.16, subdivisions (a) and (b)(2), as to
SD04-08920.
