D. 2 PUBLIC COMMENT (3 Minutes/Speaker)
Teagan Clive, reported a vacancy in the Crime Prevention Specialist position in Bay Station and
requested approval of funding.
(Funding was approved on July 7, 2015)
Kevin Kinney, said he had filed a petition of redress this morning. Mr. Kinney spoke on delays
in hearings and his opinion that many child support orders are unreasonably high, separating
children from their parents. It is Mr. Kinneys opinion that the court system has greater concern
for collecting revenue than in justice for families.
The Board noted that the County does not have jurisdiction over the courts and
recommended contacting the Clerk of the Court and the Presiding Judge.
Tanya Nemcik spoke on perceived improprieties in judgments in the Family Court in the form of
illegal incentives and a lack of assistance;
Michael Warnken, claimed justice is not being obtained in the Family Court system and
objected to closed session hearings in which there is no record of the proceedings.
Florentina Caunescu, Contra Costa Regional Medical Center (CCRMC), Marlene Stanton,
California Nurses Association (CNA), Rene Barnes, CNA, Jenny Sario (CNA), Gale Matthews,
RN (CNA), Lare Almazan (CNA), Diane Hunter, CCRMC, Kurt Rivera (CNA),
The nurses spoke on the working conditions and patient care & safety concerns at Contra Costa
Regional Medical Center, including very high staff turnover (due to low compensation and
excessive work hours), insufficient space and facilities to manage the number of patients with
patients waiting up to 24 hours to be placed in a room, compromised safety and dignity of
patients because of inadequate staffing, increasing staff injuries, excessive wait times for
patients to receive care, insufficient rooms available; and the inability to take regularly
scheduled breaks or lunches.
Dana Dean expressed her appreciation to the nursing staff for the loving care given to her mother.
D. 3 HEARING to consider adoption of Resolution No. 2015/279 approving the tax-exempt financing
and the issuance of bonds in an aggregate principal amount not to exceed $16,400,000 to be issued
by the California Enterprise Development Authority to benefit The Athenian School (Danville area).

amount not to exceed $90,000,000 to finance various capital projects and a refunding of outstanding
bonds for savings, authorizing the forms of and directing the execution and delivery of a Trust
Agreement, Site Leases, Subleases, Bond Purchase Contracts and related financing documents; and
CONSIDER authorizing the taking of necessary actions and the execution of necessary documents in

D. 6 CONSIDER approving and authorizing the Public Works Director to extend the hiring of Wanda
Quever, retired Public Works Chief of Administrative Services, in the Public Works Department,
effective August 1, 2015 through June 30, 2016. (Julia R. Bueren, Public Works Director)
Supervisor Mitchoff said she would support a 6 month extension but not a full year. She noted
concerns expressed by County employees to her that usage of retired staff limits promotional
opportunies. She further noted that the Board requested to be informed if there were difficulties
in meeting recruitment deadline, and the need to rewrite the job description was not included in
the March report.
Staff noted that there have been suggested changes and additional duties for the position
requiring additional effort for the Human Resources recruitment staff, who have already filled
26 full-time positions for the department in the last six months. The position is also part-time,
limited to 900 hours and it would be prudent to use some of that time training the new employee
in the budget process.
EXTENDED the appointment of Wanda Quever, retired Public Works Chief of Administrative
Services, for the period of August 1, 2015 through June 30, 2016.

D. 7 CONTINUE TO SEPTEMBER 22, 2015 HEARING to consider the Keller Canyon Landfill Permit
Review, the new and modified conditions of approval for the Keller Canyon Landfill land use
permit, and to consider related actions under the California Environmental Quality Act. (John

D. 8 CONSIDER accepting a report on Policy Options to Protect Youth from Tobacco Influences in the
Retail Environment from the Health Services Department and directing staff to work with affected
County Departments to evaluate modifications to the County's existing ordinances as recommended
by the Family and Human Services Committee. (Denice Dennis, Health Services Department)
Speakers: Mary Jaccodine, CC Tobacco Prevention Project; Doug Sibley, Chair of County
Alcohol and Other Drug Advisory Board; Phillip Gardiner, African-American Tobacco Control
Leadership Council; Alexander Nelson, American Lung Association; ;
Supervisor Piepho requested that the returning report include:
• specific responses to the questions raised in the letters received from the American Petroleum
and Convenience Store Association (APCA) and the National Association of Tobacco Outlets;
• The distance from youth-sensitive areas of each of the retailers potentially impacted by the
proposed ordinance
• The actual distance of a newly opened tobacco shop from the Byron Excelsior Middle School
• What additional resources law enforcement may need to enforce any new provisions of the
ordinance
Supervisor Mitchoff stated that if the licensing fee is increased that those funds should be
directed toward covering enforcement costs such as the Sheriff ’s youth-decoy sting operations
and site compliance checks.
Chair Gioia noted that the incorporated cities often parallel ordinances adopted by the County.
Supervisor Piepho mentioned that if that is so, the issue of the retailers associations regarding
forcing businesses in the unincorporated areas to relocate into the cities may not be the case. It
may instead force some establishments to close altogether. Supervisor Piepho suggested that
County staff may need to speak with the city managers via the Managers Association or at the
Mayors Conference, whichever venue is most appropriate.
All Supervisors concurred that ‘menthol’ cigarettes be included in the classifications of tobacco
products and should be specified in writing in any proposed ordinance.
ACCEPTED the report; DIRECTED staff to return to the Board with information on issues
discussed today and to work with effected County Departments to evaluate modifications to the
County's existing ordinances as recommended by the Family and Human Services Committee.
D.9 HEARING to consider certifying the Final Environmental Impact Report for the West County Detention Center Expansion
Project and related actions under the California Environmental Quality Act, Richmond area. (100% General Fund) (Julie
Bueren, Public Works Director)
Speakers: Terrance Cheung, Richmond Mayor's Office; Rick Alcaraz; Lee Lawrence, Contra
Costa Interfaith Supporting Community Organization (CCISCO). Eleanor Clarke, CCISCO,
did not wish to speak but left written comments for the Board's consideration (attached).
The Public Works Director noted that the recommendation to "DIRECT the Director of
Conservation and Development to file a Notice of Determination with the County Clerk"
cannot be completed until the project is approved.
The Board removed the direction to file a notice of completion and adopted all other
recommendations

D.10 CONSIDER approving and authorizing the Chair of the Board of Supervisors to execute the First
Amendment to the County/Allied Waste Systems, Inc. Franchise Agreement, effective August 1,
2015, to extend the term of the franchise through July 31, 2025, establish maximum collection rates,
establish the franchise fee payable to the County, expand solid waste collection services, and expand
the franchise area in the vicinity of Cummings Skyway, as recommended by the Director of
Conservation and Development. (Deidra Dingman, Conservation and Development Department)
Dana Dean, resident of Benicia, thanked the county staff and Allied Wasted Systems for
addressing the concerns voiced by herself and others in regard to the use of alternative daily
cover.
In the First Amendment to the Franchise Agreement, Item 3. Section 2 (n) reflects a date of
January 1, 2015 for the cessation of use of green waste collected in this franchise area as
alternative daily cover; this date is corrected to read September 1, 2015.
Supervisor Andersen inquired about the possibility of Canyon area being annexed into this
coverage area. Staff noted that research has already begun to determine why this once-
included area was separated many years ago and the feasibility of an annexation.
Following discussion the Board took the following actions:
FOUND that the First Amendment to the County/Allied Franchise Agreement is exempt from
the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3) of the
CEQA Guidelines, as the Amendment is not expected to cause any significant effects on the
environment;
APPROVED and AUTHORIZED the Chair of the Board of Supervisors to execute the First
Amendment to the County and Allied Waste Systems, Inc.;
DIRECTED staff to prepare recommended revisions to the Rate Setting Process and
Methodology Manual for the County/Allied Franchise, based in part on previously approved
modifications to other County Rate Manual(s), for future consideration by the Board of
Supervisors;
AUTHORIZED the Director of Conservation and Development or his designee to sign “Proof
of Designation” forms upon request of any franchise hauler collecting electronic waste from
customers within unincorporated areas served under one of the four Franchise Agreements
administered by Contra Costa County at no additional charge ;
and DIRECTED that changes to the frequency of recycling collection not be implemented until
the Board conducts a rate review.

D.13 HEARING to consider a reversion to acreage of subdivision SD03-08811 and finding of exemption
under the California Environmental Quality Act, as recommended by the Public Works Director, El

CLOSED the public hearing; ADOPTED reversion to acreage findings; ADOPTED conditions
for reversion to acreage; ADOPTED Resolution 2015/251 approving the final map of the
reversion entitled “Map Reverting to Acreage Lots 1 thru 5 Inclusive, Lee Drive and Tran Lane
Subdivision 8811.”; FOUND that the reversion to acreage of SD03-08811 is exempt from
review under the California Environmental Quality Act (CEQA); DIRECTED the Conservation
and Development Director, or designee, to file a Notice of Exemption with the County Clerk,
and DIRECTED the Public Works Director, or designee, to arrange for payment of the $50
filing fee to the County Clerk; DIRECTED the Clerk of the Board to execute a Notice of
Reversion to Acreage substantially in the form attached, pursuant to County Ordinance Code
section 924-2.010, subdivision (c), and DIRECTED the Public Works Director, or designee, to
arrange for its recording concurrently with the final map.

D.14 CONSIDER accepting recommendation of the Health Services Director to award a contract to the
Contra Costa County Fire Protection District (CCCFPD) for the provision of emergency ambulance
services, AUTHORIZE the Health Services Director, or designee, to negotiate a contract with
CCCFPD, as sole bidder for emergency ambulance services, including sub-contracting by CCCFPD
with American Medical Response (AMR), in accordance rates and terms specified in Plan A, in
response to the Emergency Ambulance Request for Proposals, for the period of January 1, 2016
through January 1, 2021 with an option to renew the contract for an additional five years and
DIRECT staff to return to the Board of Supervisors with a negotiated contract for final approval no
later than September 2015. (David Twa, County Administrator & Patricia Frost, EMS Director)

ADJOURNED In memory of Contra Costa Fire Captain Matt Burton and Fire Engineer Scott
Desmond who died in the line of duty eight years ago today while trying to rescue an elderly
couple from their burning home. Today also commemorates the district’s annual memorial
service where respects are paid to all of the men and women who have lost their lives while
serving the district.

GENERAL INFORMATION
The Board meets in all its capacities pursuant to Ordinance Code Section 24-2.402, including as the Housing
Authority and the Successor Agency to the Redevelopment Agency. Persons who wish to address the Board should
complete the form provided for that purpose and furnish a copy of any written statement to the Clerk.
Any disclosable public records related to an open session item on a regular meeting agenda and distributed by the
Clerk of the Board to a majority of the members of the Board of Supervisors less than 72 hours prior to that meeting
are available for public inspection at 651 Pine Street, First Floor, Room 106, Martinez, CA 94553, during normal
business hours.
All matters listed under CONSENT ITEMS are considered by the Board to be routine and will be enacted by one
motion. There will be no separate discussion of these items unless requested by a member of the Board or a member
of the public prior to the time the Board votes on the motion to adopt.
Persons who wish to speak on matters set for PUBLIC HEARINGS will be heard when the Chair calls for comments
from those persons who are in support thereof or in opposition thereto. After persons have spoken, the hearing is
closed and the matter is subject to discussion and action by the Board. Comments on matters listed on the agenda or
otherwise within the purview of the Board of Supervisors can be submitted to the office of the Clerk of the Board via
