Rainey, Sheriff-Coroner (` a �bATE: CountyvIIJ November 24 , 1987 SUBJECT: Appointment of Sheriff as County Fish and Game Warden SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION I - RECOMMENDED ACTION A. Approve and appoint the Sheriff as the County' s Fish and Game Warden under Section 875 of the California Fish & Game Code. B. Agree that the Sheriff, as County Fish and Game Warden, would provide quarterly reports to the Board through the County Fish and Game Commission under Section 879 of the California Fish & Game Code. C. Approve and appoint Deputy Sheriff ' s assigned to the Sheriff ' s Marine Services Bureau to act as Deputy County Fish and Game Wardens under Section 880 of the California Fish & Game Code. D. Agree to continue Board policy passed April 30, 1985 , authorizing use of funds in Budget Unit 0367 - Game Protection Fund-for the Sheriff ' s Department Marine Services Bureau subject to normal County budget and appropriat;ion procedures. II- FINANCIAL IMPACT There is approximately $24,000 in the Game Protection Fund. This fund receives revenue from fines levied from California Fish & Game Code violations. The Sheriff ' s Department Marine Services Bureau deputies have been enforcing Fish & Game laws for the past two years which has increased the fund by several thousand dollars. III- REASONS FOR RECOMMENDATIONS/BACKGROUND In April 1985 , the Board of Supervisors passed a resolution making the Sheriff ' s Department Ptrol deputies County Fish and Game Wardens. The primary goal of this proposal was to reduce illegal fish and game activities in the County�s waterways by educating the public, working with the courts and the District Attorney, and by actively pursuing violators. The funds, which have been generated by the fines, have lead to the purchase of various equipment to assist Marine Services Bureau personnel to apprehend numerous fish and game violators. The Bureau issued 425 fish and game citations in 1986 . In the first 10 months of 1987, there have been 442 citations written. The Marine Services Bureau has conducted public education talks which has addressed boating safety and fish and game laws. The last appointment was made in 1985 . It is now time to address the matter. IV CONSEQUENCES OF NEGATIVE ACTION Approximately $24 , 000 per year acquired through fish and game fines could be lost.
