SUBJECT: Contract for Weights and Measures Augmentation Funds
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
I. RECO14MENDED ACTION:
Approve, authorize chair to sign on behalf of the County, and
authorize the Agricultural Commissioner - Director of Weights
and Measures to submit to the State of California Department
of Food and Agriculture, contract for $9 ,931 in State funds
for 1986-1987 fiscal year, to augment existing County Weights
and Measures enforcement.
II . FINANCIAL IMPACT:
This contract for State funds is to augment existing County
Weights and Measures revenue. These funds were included as
projected revenue, in our 1986-1987 proposed budget and will
not require any additional funding from County funds.
III. REASONS FOR RECOMMENDATIONS:
Enforcement of Weights and Measures laws by the County is mandated
by State law. These mandates remain regardless of whether or not
other funds are available for this purpose. These funds will
improve our ability to protect the consumers of Contra Costa County
through the enforcement of Weights and Measures laws by fully funding
an authorized position which would otherwise be only partially funded.
IV. BACKGROUND:
The statewide association of County Sealers, in conjunction with
the State Division of Measurement Standards, has for sometime
promoted the concept of sharing the costs of enforcing Weights
and Measures laws between State government, County government,
and industry. This effort first materialized by the passage of
AB2987 which allowed counties to collect registration fees from
device owners . Your Board implemented that program by passage
of ordinance 83-16 and the subsequent revision ordinance 84-2 .
Now, -for the second time, the Governor has included subvention
funds in the State' s budget for augmentation of local Weights and
Measures enforcement.

In addition to providing much needed revenue for 1986-1987 ,
participation in this funding places the County in a supportive
role for future efforts to gain State subvention.
V. CONSEQUENCES OF NEGATIVE ACTION:
Failure to approve this contract will reduce field inspection
time an estimated 775 manhours . This will result in approximately
350 fewer visits to local merchants than we had projected in our
budget message. This reduction, in the wake of previous -reductions ,
would almost assure that equity does not always prevail in the
sale of commodities weighed or measured at the time of sale.
