ACCEPT a report from the Fire Chief on the status of finalizing an agreement between the Contra Costa County Fire
Protection District and the Moraga-Orinda Fire Protection District pertaining to the construction, maintenance,
operation, and staffing of proposed Fire Station 46 in western Lafayette.
FISCAL IMPACT:
No fiscal impact. Status report only.
BACKGROUND:
Contra Costa County Fire Protection District (CCCFPD) Fire Station 16 is located in western Lafayette. Fire Station
16 was vacated in June 2012 due to occupational safety issues primarily dealing with mold and rodent infestation,
and Fire Station 16 was later identified for closure due to budget reductions and was closed in January 2013.
The Moraga-Orinda Fire Protection District (MOFD) has a station in close proximity to Fire Station 16 -- Fire Station
43 in eastern Orinda. Both fire stations have relatively low call volumes. Since MOFD Fire Station 43 was scheduled
to be relocated and CCCFPD Fire Station 16 was in need of replacement, talks were initiated between MOFD and
CCCFPD regarding the

BACKGROUND: (CONT'D)
potential to operate a joint fire station facility in western Lafayette to serve both jurisdictions with one crew operating
from this shared facility. A shared facility would allow for cost savings in operations for both jurisdictions well into
the future.
Approximately 18 months ago, the CCCFPD Board of Directors provided direction to develop a joint agreement with
MOFD, and after both agencies agreed on tentative terms, to report back prior to finalizing the terms of the tentative
agreement.
Since that time a significant amount of work has gone into developing a tentative agreement. The draft agreement for
the Fire Station 46 project is nearly complete. The MOFD Board met in closed session two weeks ago. Although we
hoped the proposed language would be final, as a result of that meeting, there were some minor suggested language
changes that required legal review prior to reaching a tentative agreement.
I am hopeful that a final draft of the agreement will be available for the CCCFPD Board of Director's review at our
next meeting (August 18). That agreement will establish the framework of the administrative deal points surrounding
joint operation of a fire station. Once the Directors have approved the agreement, the MOFD Board of Directors must
also review and approve it. Thereafter we will resolve any outstanding operational and construction issues and solicit
for public input.
CONSEQUENCE OF NEGATIVE ACTION:
The report will not be accepted by the Board.
