ADOPT Resolution No. 2015/210 approving the third extension of the Subdivision Agreement (Right-of-Way
Landscaping) for subdivision SD07-08970, for a project being developed by Shapell Homes, a Division of Shapell
Industries, Inc., a Delaware Corporation, as recommended by the Public Works Director, San Ramon (Dougherty
Valley) area. (District II)
FISCAL IMPACT:
No fiscal impact.
BACKGROUND:
The terminal date of the Subdivision Agreement (Right-Of-Way Landscaping) needs to be extended. The
development is in the warranty period and the bond needs to be kept up-to-date.
CONSEQUENCE OF NEGATIVE ACTION:
The terminal date of the Subdivision Agreement (Right-Of-Way Landscaping) will not be extended and the developer
will be in default of the agreement, requiring the County to take legal action against the developer and surety to get
the improvements installed, or revert the development to acreage.
