APPROVE and AUTHORIZE the Public Works Director, or designee, to enter into a Reimbursement Agreement for
Construction Monitoring with East Bay Municipal Utility District (EBMUD) for the Orwood Road Bridge
Replacement Project, Brentwood area. County Project No.: 0662-6R4076/Federal Project No.: BRLO 5928(045)
FISCAL IMPACT:
The Federal Highway Bridge Program funds will pay 100% of the agreement.
BACKGROUND:
The County owns, operates, and maintains the Orwood Road Bridge, which connects Orwood Tract to the
transportation network in eastern Contra Costa County. The County is pursuing its Orwood Road Bridge
Replacement Project (“Project”), County Project No. 0662-6R4076. The Project includes replacing the existing
bridge structure and making improvements to Orwood Road on both sides of the bridge.
Adjacent to the Project location, EBMUD operates and maintains several pipelines that comprise its Mokelumne
Aqueduct on EBMUD-owned property. EBMUD

BACKGROUND: (CONT'D)
has granted the County permanent and temporary easements for Project improvements and construction activities.
EBMUD has also issued an encroachment permit to the County’s bridge contractor, Flatiron West, Inc., for project
within EBMUD-owned property.
Due to the proximity of the Project to the EBMUD Mokelumne Aqueduct, EBMUD will need to monitor Project
construction, to ensure that its critical water delivery facilities are protected throughout the construction of the
Project.
This Agreement is intended to provide fair and reasonable reimbursement to EBMUD for expenses it incurs to
monitor the construction of the Project. The encroachment permit issued to Flatiron West, Inc. on June 11, 2015,
is also contingent upon approval of this agreement and would be revoked prior to completion of project if the
agreement is not approved by this Board prior to July 24, 2015.
CONSEQUENCE OF NEGATIVE ACTION:
The County will not be able to reimburse EBMUD for their costs to monitor the construction of the project
resulting in EBMUD stopping construction of the portion of the project within their property. Project could not
then be completed as designed.
