HomeMy WebLinkAboutMINUTES - 06162015 - C.144RECOMMENDATION(S): Acting as the Governing Board of the Contra Costa County Flood Control and Water Conservation District, ADOPT Resolution No. 2015/216 approving and authorizing the Chief Engineer, or designee, to execute a First Amendment to Joint Exercise of Powers Agreement between the County of Contra Costa and the former Contra Costa County Redevelopment Agency relating to the Contra Costa County Public Financing Authority amending the parties to the Agreement by removing the former Redevelopment Agency and adding the Contra Costa County Flood Control and Water Conservation District and executing an Amended and Restated Joint Exercise of Powers Agreement between the parties. FISCAL IMPACT: No fiscal impact. BACKGROUND: The Contra Costa County Redevelopment Agency was created pursuant to the Community Redevelopment Law as a public body corporate and politic of the State of California. BACKGROUND: (CONT'D) On April 7, 1992 the County of Contra Costa Public Financing Authority was created by the County and the Redevelopment Agency On February 1, 2012, the Redevelopment Agency was dissolved and the Successor Agency to the Contra Costa County Redevelopment Agency was subsequently established with the objective of winding down the affairs of the former redevelopment agency. For this reason, the County and the Successor Agency intend to amend the Agreement to replace the Successor Agency as a party to the Agreement with the Contra Costa County Flood Control and Water Conservation District. CONSEQUENCE OF NEGATIVE ACTION: The former Contra Costa County Redevelopment Agency (the "Agency") would remain a party to the Joint Exercise of Powers Agreement. The Agency was dissolved effective February 1, 2012 following legislation discontinuing Redevelopment Agency operations statewide. Negative action would result in a dissolved agency continuing to be a party to the Agreement with the County. CHILDREN'S IMPACT STATEMENT: No fiscal impact.
