NOES: None. ABSENT: None. ABSTAIN: None , --------------------------------------------------------------------------- -------------------------------------------------------------------------- SUBJECT: Determination of Property Tax Exchange for Bogue Ranch Boundary Reorganization (LAFC 86-27 ) RESOLUTION NO. 86/ 661 WHEREAS, Section 99 .1 of the Revenue and Taxation Code provides that a jurisdictional change resulting from a Special District providing one or more services to an area where such services have not previously been provided shall not become effective if one or more affected special districts involved in the property tax exchange negotiation fails to adopt a resolution agreeing to a transfer; and WHEREAS, with the exception of the annexing district, the Board of Supervisors shall determine the property tax exchange for each affected district that fails to adopt a resolution agreeing to a property tax transfer; and WHEREAS, the Bogue Ranch Boundary Reorganization (LAFC 86-27 ) involves the annexation of territory to Central Contra Costa Sanitary District (CCCSD) and East Bay Municipal Utility District (EBMUD.) for which property tax exchange is determined by the previously approved master property tax exchange agreement; and WHEREAS, the reorganization proposes concurrent annexation to County Service Area L-100 (CSA L-100) for which property tax exchange is determined to be zero by Board of Supervisors Resolution 86/541; and WHEREAS, the reorganization also proposes concurrent annexation of territory to County Service Areas P-2 and R-7A (CSA P2 ) and (CSA R-7A) respectively, annexation to the San Ramon Valley Fire Protection District ( SRVFPD) and the concurrent detachment of territory from the Contra Costa County Fire Protection District (CCCFPD) and no resolutions have been adopted agreeing to property tax exchanges regarding the County Service Areas and fire districts involved in the subject reorganization; and WHEREAS, for the property tax allocation to be made under this resolution, the Auditor-Controller of Contra Costa County shall first apply the provisions of the master property tax agreement between the Central Contra Costa Sanitary and East Bay Municipal Utility Districts and the County and then apply the tax increment allocation factors for property tax increment apportionment to CSA P-2, CSA R-7A, and SRVFPD as shown on the attached schedules marked Exhibits A-1 and A-2; and WHEREAS, in the case of the fire district annexation/detachment element of the reorganization, 100% of the property tax accruing to CCCFPD from the affected territory of the Bogue Ranch Boundary Reorganization (LAFC 86-27) shall be transferred to SRVFPD; THEREFORE, BE IT BY THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY RESOLVED that 100% of the property tax revenues accruing to Contra ,Costa County Fire Protection District from the affected territory of the reorganization shall be transferred to San Ramon Valley Fire Protection District and that the property tax increment allocation factors for the affected agencies in the area of the Bogue Ranch Boundary Reorganization RESOLUTION NO. 86/ 661 (Page 1 of 2) (LAFC 86-27 ) shall be as shown on the attached schedules (Exhibits A-1 and A-2) , for the fiscal year for which the State Board of Equalization makes the tax rate area changes for this jurisdictional change. Said factors shall apply in subsequent years unless changed by the mutual agreement of affected agencies or subsequent jurisdictional changes. Said increment tax allocation factors apply to affected territory as submitted or revised by the Local Agency Formation Commission. This resolution does not change the affected districts ' right to collect taxes for existing bonded indebtedness. cc: Contra Costa Resource Conservation District Contra Costa Mosquito Abatement District .
