SUBJECT: Approval of AB541 DUI Program Fee Schedule and Detention Facility
DUI Information and Referral Program
SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION
I. RECOMMENDED ACTION:
A. Approve the attached fee schedule, effective November 4, 1986, for Level I
Driving Under the Influence (DUI) programs; and
B. , Approve the DUI Information and Referral Program at the County Detention
Facility as part of the AB541 countywide DUI Program.
II. FINANCIAL IMPACT:
These programs do not require any expenditure of County funds. The programs are
entirely self-supporting from client fees . The current Level I DUI Program charges
participants $100 for the 18-hour Level I Alcohol Education Program and is applied
on a sliding scale. The new fee schedule represents a 15% increase to a new maxi-
mum of $115. The increase is being requested to cover the following costs:
8% Detention Facility DUI Information & Referral Program
6% Cost of Living Adjustment of program providers
1% DUI data collection by designated provider

III. REASONS FOR RECOMMENDATIONS/BACKGROUND:
On- March 2, 1982 the Board approved a comprehensive program of alcohol education
and alcoholism treatment services to implement AB 541 which allows individuals
arrested and convicted for first offense driving under the influence (DUI) an
alternative to jail by participation in a Level I Alcohol Education Program. The
entire costs of these services are paid by client fees.
The current program at the County Detention Facility which was developed subsequent
to ;the Board's 1982 approval of alcoholism education and treatment services can be
considered the initial phase of the AB541 DUI Program and the Department is hereby
requesting the Board's approval of this program which serves mainly first (DUI)
offenders. The Program at the Detention Facility is an information and referral
service for individuals who are apprehended and charged with DUI by the police.
These individuals cannot drive safely so they are taken to the Detention Facility
and then released as soon as they are sober. An alcohol program counselor staffs
the Detention Facility and provides the individuals with information regarding
alcohol programs with the hope of preventing future DUI arrests and preparing indi-
viduals for entry into the Level I DUI Alcohol Education Program. Upon arraignment
in court, approximately three to six months after the arrest, the individual can
elect to enter an established AB541 Program as an alternative to a,44itional jail
time. ->
