SCHEDULE 9 WEST COUNTY JUSTICE CENTER ORA PROGRESS REPORT NO. 3 SEPTEMBER 1986 I. PROJECT DEVELOPMENT A. Current Status 1. Design Specific floor plans have been developed for all buildings based on the Pre-design program and modifications resulting from the design workshops. The site development concept is based on a well defined patrolled security perimeter surrounding a building complex consisting of the housing module (four buildings with 128 single cells each), a 56 bed intake housing unit, health services, central visiting and program space. This complex will connect to the administration/support services building through a tunnel passing under the perimeter security fences and patrol road. The administration/support services building will have both secure and non-secure areas and will include a public lobby, administration offices, central control room, inmate processing, a kitchen and laundry, and space for maintenance and warehousing. Design workshops were held on September 15, 16 and 30. The design effort to date has concentrated on site development concepts, building plans and general building form. Circulation and security have been given special attention. As part of this design development process, the 25% draft of the integrated security plan has been submitted and is being reviewed by County staff. On September 2 through 5, members of the Design Team visited three jails* in South Carolina, North Carolina and Maryland. All three facilities operate with direct deputy supervision of inmates. The design for two of these institutions allow controlled "free movement" of inmates within the central areas of these multiple building, campus type facilities. The major benefits of the visits include review of perimeter security, inmate management, F housing units, delivery of meals to the housing units and inmate work programs. Community Participation • i The WCJC Advisory Group held its monthly meeting on September 24 at Maple Hall in San Pablo. All three standing committees have been organized and are holding meetings. Two major committee issues" were presented at the Advisory Groups monthly meeting: facility design and a Minority Business Enterprises draft policy proposed for use in selecting County consultants. The discussion of the WCJC design included a status report of project development and a listing of concerns discussed in the Design Committee meetings. The Minority Business Enterprises draft policy was presented to the group for their review with comments due October 8. The Design Committee met on September 9, 18, 23 and 30 to review and comment upon design concepts as they develop. To date, most attention has focused on site development and building massing. The Committee's concerns include views of the facility from surrounding property, landscaping plans, perimeter security, parking, building proximity to the park entry and site lighting. One of the meetings was held at the site in which the site boundaries, perimeter security roads, major buildings and parking were generally located. Building heights were also estimated. The Employment and Training Committee met on September 11 and 23. The first meeting was centered around the project's major consultant's plans for using local minority sub-consultants during the preconstruction phase of the project. The second meeting finalized work on the Committee's draft policy for recommended j adoption by the County. This policy proposes using local minority j business enterprises, both professional consultants and suppliers. The Related Facilities and Services Committee held its first meeting on September 23. Chaired by Barbara Cross, this meeting discussed the role of the Committee. Information on programs and ,+ services currently offered at the county's detention facilities is being sent to the Committee members. 3. Site Acquisition In early September, the Haley-Leslie Idiart Appraisal Company submitted a preliminary estimate of value for the project site based on a survey of comparable sales. °a 2 WEST COUNTY JUSTICE CENTER OBA PROGRESS REPORT NO. 3 SEPIEHBER 1986 The appraiser is now preparing an additional analysis to determine if severance or benefit resulting from the County's site acquisition and development will have an affect on the site's value. A second appraisal company, Clevenger Realty Appraisal Corporation, has been hired by the County to prepare a second, independent appraisal. Because of the size and complexity of this acquisition, the possibility of a condemnation lawsuit, the project team agreed that two appraisals were necessary. Both appraisals are due the first part of November. Upon acceptance of these two appraisals, i a formal offer will be made to Pinole Point Properties, currently scheduled for December 1. '? 7 4. Environmental Review The Board of Supervisors approved the project and its Environmental Impact Report on August 26. A Notice of Determination was filed with the County Clerk on the same day. On September 24, 30 days later, the current site owner filed with the Court a Petition and Complaint challenging the WCJC project on CEQA grounds. The specific allegations of the complaint are being reviewed by County Counsel and the Community Development Depart- ment. B. Upcoming Activities 1. Design The Architect and his subconsultants will spend the first two weeks of October on further design refinements and preparation of the formal Schematic Design Phase submission due October 15, The County departments and California Board of Corrections will have one month to review this submission. A Board Order commenting on this submission and authorizing the Design Development Phase will be presented to the Board of Supervisors for approval at their November 18 meeting. The Sheriff's Department, General Services Department and County Administrator's Staff (Justice System Programs) will be given complete sets of drawings for concurrent review. 3 WEST COUNTY JUSTICE CENTER OBA PROGRESS REPORT NO. 3 SEPTEMBER 1986 2. Comm<mity Participation The Advisory Group will meet on October 22. The major agenda items will include presentation of reports from the Design Committee and Employment and Training Committee. If approved, these reports will be forwarded to the Board of Supervisors for their information and action. The report from the Design Committee will represent the Committee's design review comments and recommendations based on ti the Schematic Design Phase submission. The Employment and Training Committee will recommend Advisory Group endorsement of its Minority Business Enterprise Policy for consideration by the Board of Supervisors in establishing an affirmative action policy for selecting consultants and vendors. All three Advisory Group Committees have meetings scheduled in October. 3. Site Acquisition The final site boundary will be established the week of October 6 at which time the County's consulting survey engineer will be asked to prepare a legal description, including proposed easements and rights-of-way. This information is needed by the appraisers before they can complete their reports. Because of the pending environmental law suit and probable condemnation, the County staff has decided not to schedule preliminary negotiation meetings with the property owner. A formal site purchase offer is still scheduled to occur by December 1. 4. Environmental Review The County has 30 days to respond to the environmental lawsuit. This suit may result in the issuance of a Temporary Restraining Order, thus having the potential for delaying the site acquisition process or off-site construction scheduled next spring and summer. County Counsel is currently developing a defense strategy to minimize the risk of project delay while this legal challenge is resolved in court. The design and site acquisition activities will continue as scheduled, unless halted by a court order. 4 WEST COUNTY JUSTICE CENTER ORA PROGRESS REPORT NO. 3 SEPTEHBER 1986 II. PENDING ACTION ITEHS f A. Define the Site Boundaries Problem: _ The selected project site is a portion of a larger site. r Before an offer can be made, the site boundaries, site area and new easements and rights-of-way must be surveyed and defined. This , information is also needed by the appraisers before they can complete ! their work. c: Action: The County has hired a civil surveyor to prepare topographic drawings and a legal description of the site. The exact placement of the northern property line will be set once the preliminary architectural site development studies have been completed. The size and placement of buildings, including anticipated expansion, were discussed at the third and fourth workshops. Once the Architect loads the site and building information into their CAD computer, they will be able to recommend the location of the site boundaries. This information is expected by October 6. The civil engineer should then have a legal description ready by October 15 for use by the appraisers }; and in preparing a formal site offer. B. East Bay Regional Park District Objections Problem: During the project Environmental Impact Review process, the East Bay Regional Park District expressed concern about the impact the jail project will have on Point Pinole Regional Park. These concerns are based on a variety of environmental (site drainage, endangered species, noise and land use issues). Action: The County, as part of the EIR process, committed to minimize the impact of the project on the adjacent park. To mitigate their concerns, the County has had periodic design review meetings with the Park District staff. These meetings have focused on screening the WCJC from both the existing park entrance as well as a potential new park entrance along the site's northern property line. County staff will meet with the Park District on October 10 to explore the feasibility and define the challenges to and opportunities with the Park District's plan to acquire additional land enabling them to establish a new park entrance. 5 WEST COUNTY JUSTICE CENTER OKA PROGRESS REPORT NO. 3 SEPTEMBER 1986 III. AREAS OF CONCERN 1. Site Acquisition The site acquisition process was scheduled to occur the same time the project was being designed. This process, currently within schedule, was timed so that the County would take possession of the site prior to its issuing the "off-site" construction contract for bid next spring. On September 25, the property owner file a Petition and Complaint in the Superior Court challenging the WCJC project on environmental (CEQA) grounds. Although the issues being challenged appear to be defensible, the time required to take this action through the legal process to resolution has the potential of delaying the site acquisition process and ultimately construction. During the coming weeks, County Counsel and members of the Project Team will evaluate 4 the potential time impact this lawsuit may have on the overall project schedule and develop one or more scenarios to minimize the risk of project delay. This risk analysis should evaluate all cost impact, such as legal fees, land costs and construction cost escalation. In order to minimize the County's exposure to both increased costs and project delay, the County should be prepared to aggressively defend itself if such a course of action is recommended. A legal strategy will be developed by mid-October. i 'i i9 a , y `9 A, 6 WEST COUNTY JUSTICE CENTER ORA PROGRESS REPORT NO. 3 SEPTEMBER 1986 IV. COST REPORT i The total project budget for the West County Justice Center is $48,760,695, of which $36,507,521 is to be provided by the California Board of Corrections. Section 12 of the project predesign program, approved by the Board of Supervisors on July 8, provides a cost breakdown for design, construction, site acquisition and miscellaneous costs. The following cost summary is based on this cost breakdown and shows both contractual obligations and County expenditures to date. During the last budget reporting month (August 13 - September 11), $222,531 in payments was issued. t County appropriations to date total $7,588,169.1 Based on current projections, a cumulative total of approximately $2,478,000 will be spent !: for project consultants, supplies and County staff reimbursements as of June 1987, the end of this fiscal year. The remaining $5,110,000 is � available for the site purchase and off-site development planned for N5 [ Spring 1987. The actual purchase price of the site will determine the remaining available funds for site development. Estimated land cost ranges from $4,750,000 to $5,250,000 and the County portion of the off-site construction has an estimated cost range of $1,250,000 to f_ $2,000,000. Through the use of Public Facilities Corporation funds earmarked for this project and the reprogramming of a limited amount of other County funds, it appears that an off-site contract can be awarded this fiscal year. Should this contract be delayed until July, when the 1987-88 year funds become available, it would not delay the next phase of construction. 1The total appropriation does not include any funds from the County's Public Facilities Corporation. 7 WEST COUNTY JUSTICE CENTER OSA . PROGRESS REPORT NO. 3 SEPTEMBER 1986 V. S®ULE The Schematic Design Phase submittal is due October 15, to be followed by a one-month County and Board of Corrections review period. The review comments and recommendations will be presented to the Board of Supervisors for action on November 18. This first phase of design is on schedule. The two consulting appraisors are under contract and preparing reports due the first week of November. A formal offer will be made upon acceptance of the two appraisals. Because of anticipated legal action (CEQA challenge and condemnation), a planned preliminary negotiation has been eliminated. This change does not affect the schedule. Site acquisition is currently on schedule; however, if a restraining order is issued as part of the environmental lawsuit, the County may be forced to temporarily stop a part of the site acquisition process. In order to issue the off-site construction contract in May 1987, the architect will perform preliminary engineering and prepare final contract documents concurrent with the Design Development Phase of the WCJC. Both Bidding Documents for the off-site work (roads and utilities) and the Design Development phase submittals are scheduled for completion on = March 18.
