DIRECT the Real Estate Division to have the above referenced Grant of Easement recorded in the office of the County Recorder. FISCAL IMPACT: 100% Flood Control Permit Fees BACKGROUND: The Contra Costa County Flood Control and Water Conservation District (District) issued a permit to the City to do work within the District’s access easement as part of the City’s Marsh Creek Restoration at Creekside Park project (Project). As part of the Project, the District’s access road along the west bank of Marsh Creek was removed. BACKGROUND: (CONT'D) the District requires and the City agrees to provide a replacement access easement to Marsh Creek. A California Environmental Quality Act (CEQA) Determination of Exemption was approved on August 17, 2011, by the Zoning Administrator and the Notice of Exemption was posted on August 18th for 30 days. CONSEQUENCE OF NEGATIVE ACTION: The District will not have adequate access to Marsh Creek. CHILDREN'S IMPACT STATEMENT: Not applicable. ATTACHMENTS Grant of Easement
