APPROVE and AUTHORIZE the Chief Engineer, Contra Costa County Flood Control and Water Conservation
District (District), or designee, to execute a temporary permit for ingress and egress purposes with Chevron U.S.A.,
Inc., effective March 31, 2015 through December 31, 2015, for the North Richmond Pump Station Storm Water
Diversion Project. (Project No. 7517-6W7246)
FISCAL IMPACT:
No fiscal impact.
BACKGROUND:
The District is preparing for construction of the North Richmond Pump Station Storm Water Diversion Project
(Project).
In order to move forward with Project construction, the District needs a temporary permit for ingress and egress
(Permit) to occupy a 30-foot-wide portion of Assessor’s Parcel Number 561-110-040 (Property). The Property the
District needs to occupy and use is owned by Chevron U.S.A., Inc. (Property Owner) and is adjacent to and west of
the District’s pump station property.

BACKGROUND: (CONT'D)
The Permit will allow the District to occupy the Property for Project construction until the Project is completed, or
December 31, 2015, whichever occurs first. As a condition of the Permit, the Property Owner has required the
District to indemnify the Property Owner for claims arising out of the District’s use of the Property or the
construction of the Project.
Because the District needs access to the Property to construct the Project, District staff recommends that the Board
of Supervisors authorize the execution of the Permit.
CONSEQUENCE OF NEGATIVE ACTION:
The construction phase will not be able to move forward.
