Supervisors Schroder, McPeak, Torlakson, Powers NOES: None ABSENT: None ABSTAIN: Supervisor Fanden -------------------------------------------------------------------- -------------------------------------------------------------------- SUBJECT: Land Use Permits for Development Projects Including Hazardous Waste or Materials The Board on October 14, 1986 deferred decision to this date on the proposed ordinance requiring land use permits on develop- ment projects including hazardous waste or materials. The following persons appeared and urged the Board to adopt Version 1A, as amended, of the proposed ordinance: Robert Judd, 2606 Dwight Way, Berkeley, representing the Environmental Defense Fund; Rosemary Corbin, 114 Crest Avenue, Richmond, representing the Local Government Commission; Kathy Radke, 834 Carquinez Way, Martinez; Denny Larson, 2131 University, X6400 , Berkeley, representing Citizens for a Better Environment; Wayne Klier, 2261 N. Main Street, X6204, Walnut Creek; Tom Adams, 1875 S. Grant, X6600, San Mateo, representing the Building Trades Council; Jean Siri , 1015 Leneve Place, E1 Cerrito, representing the West Contra Costa Conservation League; Leslie Stewart, 3398 Wren Avenue, Concord, representing the League of Women Voters, Richmond Area and Diablo Valley; and Russell Greenlaw, 643 Abrigo Court, San Ramon, representing Firefighters Local 1230. The following persons did not speak, but left comments in support of Version 1A, as amended: Elizabeth R. Patterson, 122 Carlisle Way, Benicia, repre- senting the Sierra Club, Bay Chapter; and James Marieiro, 138 Clipper Lane, Martinez, representing the Blum Road Alert Committee. Chairman Powers noted that letters supporting Version 1A, as amended, had been received from the following: Environmental Defense Fund, 2606 Dwight Way, Berkeley; West Contra Costa Conservation League, 1015 Leneve Place, E1 Cerrito; West Contra Costa County Gray Panthers, 2023 Key Blvd. , E1 Cerrito; F' 1 I Golden Empire Health Planning Center, 2100 21st Street, Sacramento; and League of Women Voters of Diablo Valley, 500 St. Mary's Road, #14, Lafayette. Bryant Fischback, 1324 E1 Curtola Blvd. , Walnut Creek, representing the Council of Industries - West County, the Contra Costa Council, and the Industrial Association of Contra Costa County, stated that he believed that all parties involved in drafting the ordinance were close to agreement on a compromise version that would be mutually acceptable. He recommended that a decision be deferred until the differences could be resolved. Board members discussed the various versions of the ordi- nance and the amendments proposed. Staff was requested to draft an amended version of the ordinance , . incorporating suggestions and amendments proposed by Board members. Decision was deferred until later in the day. IE�tt In the afternoon, the Board discussed the various versions of the proposed ordinance and amendments. Supervisor Torlakson commented on certain unresolved issues and suggested they be reviewed by the Hazardous Materials Commission. The Board agreed that decision on the proposed ordinance for Land Use Permits for development projects including hazardous waste or materials is DEFERRED to November 4, 1986 and County Counsel is REQUESTED to incorporate revisions as proposed into a final draft ordinance. Supervisor Torlakson moved to direct the Health Department, Riverview Fire District, and Community Development Department to review the USS POSCO proposal for plant expansion to determine any recommendations they would make to make it a safer operation and identify any concerns related to the use of hazardous chemicals in that process and further direct the staff to contact the Regional Air and Water Quality Boards staffs regarding their review of the project for the same concerns regarding hazardous waste and materials.
