AUTHORIZE issuance of California Public Utility Commission (CPUC) grant funded payment of $5,000 each to the
cities of Antioch, Brentwood, Oakley, and San Pablo to defray their costs for participating in the Bay Area Regional
Energy Network Codes and Standards Permit Resource Opportunity Program.
FISCAL IMPACT:
There will be no impact to the General Fund. The full cost of reimbursement payments to the cities is covered with
CPUC grant funding.
BACKGROUND:
In July 2012, the County joined the Bay Area Regional Energy Network (BayREN), a collaborative partnership
among the nine (9) Bay Area counties (Alameda, Contra Costa, Marin, Napa, San Francisco, San Mateo, Santa Clara,
Solano and Sonoma) and led by the Association of Bay Area Governments (ABAG), which focuses on implementing
grant funded energy efficiency programs throughout the Bay Area.
On July 9, 2013, the County entered into a contract with ABAG that was then amended on June 3, 2014, in an
amount not to exceed $381,917, containing requirements associated with the County's use of CPUC grant funding for
the period of January 1, 2013 through December 31, 2014. The contract provides for reimbursement of allowable
marketing, education and outreach costs incurred by the County for countywide programs that include rebates for
energy efficiency retrofits to single-family and multi-family buildings, energy efficiency financing, and assistance
with the implementation of a Building Codes and Standards Program.

BACKGROUND: (CONT'D)
The Codes and Standards portion of the contract with ABAG requires the County to recruit five (5) building
inspection agencies to participate in a Permit Resource Opportunity Program (PROP), developed by ABAG to assist
local governments with assessing, improving, and tracking energy code compliance. The County reached out to all
nineteen (19) cities within the County and the following four (4) city building inspection departments elected to
participate in the PROP: Antioch, Brentwood, Oakley, and San Pablo.
These four (4) cities as well as the County Building Inspection Division participated in the PROP. Participating cities
and the County had to dedicate a generous amount of staff time and resources involving an intensive three to four day
on-site review of energy code compliance conducted by ABAG’s BayREN energy code consultants. The energy
code compliance assessments included the review of three to four building projects at or near completion located
within each participating city's jurisdiction.
The current contract between the County and ABAG allows CPUC grant funds to be used to cover all agency costs
associated with participation in the PROP, including issuing grant funded reimbursement to other jurisdictions to
defray their cost for participating in the PROP. The Department of Conservation & Development staff is
recommending that the Board of Supervisors grant authorization to issue one-time reimbursement payments of CPUC
funds to these participating cities.
CONSEQUENCE OF NEGATIVE ACTION:
The four (4) cities that participated in the BayREN PROP would not receive reimbursement for participating, which
would likely negatively impact their willingness to participate in any future BayREN programs. CPUC grant funds
provided to the County would also go unspent, which may impact the County’s ability to receive additional grant
funds in subsequent years.
