D. 3 HEARING on the itemized costs of abatement for property located at 3010 Del Hombe Lane, Walnut Creek, CA

D.4 HEARING on the recommendation of the County Planning Commission to nominate two trees located on 2444
Lunada Lane in Alamo as Heritage Trees (COUNTY FILE #HT12-0001) (Lashun Cross, Department of
Conservation and Development)
Speakers: Don Filippi, neighboring property owner, Alamo.
It was noted during the hearing that one of the trees straddles two properties. Supervisor Andersen directed that
the language of the relevant documents be amended to reflect both the 2444 and 2446 Lunada Lane addresses.
CLOSED the public hearing; DESIGNATED the specified two Valley Oak trees at 2444 Lunada Lane in Alamo
for Heritage status under the Heritage Tree Preservation Ordinance pursuant to the recommendation of the
County Planning Commission as contained in Resolution No. 2013-16; and DIRECTED staff to post a Notice
of Exemption with the County Clerk.
D.5 HEARING to consider the County Planning Commission recommendation to adopt the 2014 Housing Element
Update to the County General Plan. (Patrick Roche, Conservation and Development)
By unanimous vote approved addition of a PowerPoint presentation into the record (attached).
CLOSED the public hearing;
ADOPTED a Negative Declaration of Environmental Significance that the 2014 Housing Element Update will
not result in any new significant impacts on the environment and determine that this environmental review is
adequate consideration for this General Plan Amendment;
ADOPTED the 2014 Housing Element Update (as recommended in County Planning Commission Resolution
No. 12-2014) as the third consolidated General Plan Amendment for calendar year 2014, as allowed under
State Planning Law, and acknowledged that this amendment would supersede and replace text, maps, and
related appendices for Chapter 6. Housing Element contained within the Contra Costa County General Plan
(2005-2020);
AUTHORIZED the Chair, Board of Supervisors, to sign cover transmittal letter and forward the adopted 2014
Housing Element update to the California Department of Housing and Community Development for final
review and certification (attached);
and DIRECTED the Department of Conservation and Development to file the Notice of Determination for the
Negative Declaration on this project with the County Clerk.

D.6 CONDUCT HEARING on the adoption of Resolution No. 2014/381 to establish and update service fees for the
Environmental Health Division of Contra Costa County Health Services, to be effective January 1, 2015;
CONSIDER adoption of Ordinance No. 2014-12 authorizing the collection of a plan review fee for plan reviews and
inspections of food facilities and public swimming pools; and MAKE related California Environmental Quality Act
findings. (William Walker, M.D., Health Services Director; Marilyn Underwood, Environmental Health Director)
The department provided informational charts "Current and Proposed Fees Compared to Other Jurisdictions"
and "Current and Proposed Well Activity Fees Compared to Other Jurisdictions" to assist in Board
considerations, after the publication of the Agenda. By unanimous vote, the Board accepted the materials into
the record (attached).
CLOSED the hearing;
FOUND that the proposed fee adjustments are exempt from the California Environmental Quality Act (CEQA)
pursuant to Section 15273 of Title 14 of the California Code of Regulations;
ADOPTED Ordinance No. 2014-12, authorizing the collection of a plan review fee for plan reviews and
inspections of food facilities and public swimming pools, and authorizing Environmental Health to prorate
operating permit fees on a quarterly basis for businesses that commence operations after the beginning of a
permit year, and issue specified refunds to permitted businesses that cease operation or are transferred to
another person before the end of a permit year;
ADOPTED Resolution No. 2014/381, establishing and updating fees for the Environmental Health Division,
effective January 1, 2015, superseding Resolution 2014/26 in its entirety and superseding Resolution 2007/509
as to all Environmental Health Division rate charges and fees not set by Resolution No. 2014/26, with the
exception of solid waste program fees, which shall continue in full force and effect;
DIRECTED the Conservation and Development Director, or designee, to file a Notice of Exemption with the
County Clerk and DIRECTEDthe Health Services Department to pay the Department of Conservation and
Development $25.00 to process the Notice of Exemption, and pay the County Clerk $50.00 to file the Notice of
Exemption.

All matters listed under CONSENT ITEMS are considered by the Board to be routine and will be enacted by one motion. There will be
no separate discussion of these items unless requested by a member of the Board or a member of the public prior to the time the Board
votes on the motion to adopt.
Persons who wish to speak on matters set for PUBLIC HEARINGS will be heard when the Chair calls for comments from those
persons who are in support thereof or in opposition thereto. After persons have spoken, the hearing is closed and the matter is subject to
discussion and action by the Board. Comments on matters listed on the agenda or otherwise within the purview of the Board of
