HomeMy WebLinkAboutMINUTES - 12092014 - C.53RECOMMENDATION(S): APPROVE and AUTHORIZE the Public Works Director, or designee, to execute the Agreement for Sale of Conservation Credits between the County and Ohlone Preserve Conservation Bank for the County’s purchase of Alameda whipsnake and California red-legged frog mitigation credits for habitat impacts associated with the Alhambra Valley Road Safety Improvements (East of Bear Creek Road) in the amount of $129,250, as recommended by the Public Works Director, Martinez area. (District V) [Project number 0662-6R4101] FISCAL IMPACT: The total estimated project cost is $1.6 million funded by 44% Federal Highway Safety Improvement Program (HSIPL), 38% Federal High Risk Rural Road (HRRRL) Program and 18% Local Road Funds. BACKGROUND: On February 28, 2012, the Board approved the Alhambra Valley Road Safety Improvements (East of Bear Creek Road) project and made related findings under the California Environmental Quality Act (CEQA). This road safety improvement project is included in the 2009 Capital Road Improvement and Preservation Program (CRIPP) for fiscal year 2009/10 to 2015/16. BACKGROUND: (CONT'D) east of Bear Creek Road to provide shoulders and clear recovery areas for motorists to regain full control of their vehicles should they veer off the traveled way. The project is located within designated critical habitat for federally-listed Alameda whipsnake and California red-legged frog and will result in permanent impacts to 1.33 acres and temporary impacts to 2.62 acres for a total of 3.95 acres of impact. The U. S. Fish and Wildlife Service and California Department of Fish and Wildlife require the purchase of mitigation credits from a U. S. Fish and Wildlife Service and California Department of Fish and Wildlife approved mitigation bank at a 2:1 ratio for permanent impacts and 1.1:1 ratio for temporary impacts to compensate for these impacts, resulting in a total of 5.5 acre credits Ohlone Preservation Conservation Bank for a total of $129,250 to satisfy this requirement. The Agreement for Sale of Conservation Credits has been approved by the U. S. Fish and Wildlife Service and the California Department of Fish and Wildlife. CONSEQUENCE OF NEGATIVE ACTION: If the execution of the Agreement for Sale of Conservation Credits is not approved by the Board of Supervisors, the project would not be in compliance with Section 7 of the Endangered Species Act and Section 2081 of the California Endangered Species Act consultations for the project.
