APPROVE and AUTHORIZE the Chair of the Board of Supervisors to execute, on behalf of Contra Costa County
(County), the Real Property Services Agreement to provide right of way services to the Bay Area Infrastructure
Financing Authority, a Joint Powers Authority between the Metropolitan Transportation Commission and the Bay
Area Toll Authority (BAIFA) for BAIFA’s I-680 Express Lanes Project, for payment to the County in an amount not
to exceed $25,000, effective December 2, 2014 until terminated by either party, I-680 Corridor area. (Project No:
4500-6X5886)
FISCAL IMPACT:
100% BAIFA funding; incoming funds.
BACKGROUND:
BAIFA requires a variety of right-of-way services for its I-680 Express Lane Project, but has no right of way staff.
BAIFA desires to contract with the County for these right of way services. Under the Real Property Services
Agreement (Agreement), Public Works Department

BACKGROUND: (CONT'D)
Real Estate Division staff will perform various right-of-way services, including but not limited to right of way
appraisal, negotiations, and supervision of independent consultants. BAIFA will pay the County for those services
based on the County’s labor costs, up to the payment limit of the Agreement. If the payment limit is reached
and/or additional services are necessary, the parties would need to amend the Agreement. The Agreement is
attached.
CONSEQUENCE OF NEGATIVE ACTION:
BAIFA will not be able to contract for the County’s right of way services.
