HomeMy WebLinkAboutMINUTES - 12022014 - C.02PRECOMMENDATION(S): APPROVE and AUTHORIZE the Chair of the Board of Supervisors to execute, on behalf of Contra Costa County (County), a Grant of Access Rights over a portion of Balfour Road to the Barbara A. Frantz Family Trust dated 2004 property for an access easement pursuant to Streets & Highways Code § 960. Project No. LP07-2081 DETERMINE that the conveyance of said access rights is in the public interest and will not substantially conflict or interfere with the County’s use of the property. DIRECT the Real Estate Division of the Public Works Department to cause said Grant of Access Rights and a certified copy of this Board Order to be recorded in the office of the County Recorder. FISCAL IMPACT: 100% Applicant Fees. BACKGROUND: The County accepted an Offer of Dedication for roadway purposes which included the relinquishment of abutter’s rights for a portion of Balfour Road. BACKGROUND: (CONT'D) The current property owner has submitted an application for a land use permit requesting an additional driveway to their property identified as Assessor’s Parcel Number 015-150-009. A condition of the permit requires the property owner to obtain a 35-foot wide Grant of Access Rights from the County over a portion of Balfour Road. A Notice of Determination for a California Environmental Quality Act Negative Declaration was filed on December 5, 2008 by the Contra Costa County Department of Conservation and Development for Barbara A. Frantz “Tess’s Farm Market.” CONSEQUENCE OF NEGATIVE ACTION: The property owner will not obtain the rights necessary to access their property as conditioned in the land use permit.
