BRAGDON, DIRECTOR OF COMMUNITY DEVELOPMENT DATE: October 9, 1986 SUBJECT: Transportation System Management (TSM) Ordinance Specific Request(s) or Recommendation(s) & Background & Justification RECOMMENDATION 1. Endorse the model TSM ordinance submitted_by the Contra Costa Transportation Advisory Committee. 2. Authorize the Director of the Community Development Department to work with the business community, the cities, and transportation agencies to modify the model TSM ordinance for implementation in all unincorporated areas not affected by the Pleasant Hill BART Station Area TSM ordinance, and submit the draft ordinance to the Board for its approval. FINANCIAL IMPACT No immediate financial impact will result from approval of staff recommendations. However, adoption of the TSM ordinance for the Pleasant Hill BART station area created the position of the County TSM Coordinator without the funding for additional staffing. The County TSM Coordinator must work with the business community and local transportation agencies to meet the ordinance requirements and monitor compliance. If a TSM ordinance is adopted for the remaining unincorporated areas, the staffing needs for a County TSM Coordinator would be greater. The Community Development Department does not have authorization to hire additional staff for this purpose. Such authorization would be necessary each year the ordinance would be in effect. REASONS FOR RECOMMENDATION/BACKGROUND The Board of Supervisors has recognized that solutions to the county's transportation problems involve not only expanding our roads and transit systems, but also using these facilities more efficiently. An effective way to achieve this efficiency is to have the business community participate in transportation system management (TSM) programs that encourage commuting by some means other than driving alone to work. Initial actions by the Board to encourage the use of TSM strategies involved conditioning new development with participation in TSM programs to reduce traffic impacts. Westman - County Counsel CCTAC By K,f„c L EPUTY The need and opportunity for the use of TSM in the Pleasant Hill BART station area resulted adoption of a TSM ordinance for existing and new development located in unincorporated areas adjacent to the BART station. That action was taken in June of 1986, and has been the first attempt by the Board to establish uniform TSM requirement for existing and new development with specific provisions to ensure compliance and long term implementation. The model TSM ordinance applies the regulatory approach to TSM countywide. Flexibility has been incorporated into the ordinance to recognize the diversity of the local economy and local government. Implementing TSM strategies through an ordinance explicitly indicates the minimum TSM requirements, provides for their uniform application and, if enforced countywide, can measurably affect .traffic growth. Endorsement of the model ordinance as requested by CCTAC would indicate the Board's intention to develop TSM regulations for the remaining portions of unincorporated Contra Costa County. The model ordinance provides the County with a detailed description of the provisions necessary for a workable ordinance. Staff evaluation indicates implementation of such an ordinance for the remaining unincorporated areas would complement the existing TSM ordinance for the Pleasant Hill BART station area. The second recommendation would authorize the County's participation in efforts by local jurisdictions to review the model TSM ordinance. CCTAC has submitted the ordinance to the Mayors' Conference, recommending referral to all 18 city councils. Forums available for joint city/County review include Central County's TRANSPAC, the West County Transportation Advisory Committee, and Supervisor Torlakson's Highway 4 Task Force/East County BART Coalition. Local transportation agencies, should also be included in the review process. Joint review would promote consistency in the planning and implementation of TSM strategies within the County. The County would also benefit from participating in CCTAC's efforts to educate the business community on the model TSM ordinance. CCTAC has currently targeted the Contra Costa Council, Bay Area Council, Council of Industry for Western Contra Costa County, and the Diablo Valley Property Manager Association for informational presentations. The County needs input from such groups to because the cooperation and support of the business community is essential to successful implementation of a TSM ordinance. Both recommendations are consistent with the terms of the Dimmick lawsuit settlement to which the Board and the Redevelopment Agency are parties. The settlement provides for the creation of the Contra Costa County TSM Committee, which will include one supervisor, to promote the implementation of a TSM ordinance in unincorporated Contra Costa County and the cities. CONSEQUENCES OF NEGATIVE ACTION If the Board does not approve staff recommendations or similar substitute actions, it should direct staff not to participate further in activities to implement TSM regulations in the remaining portions of unincorporated Contra Costa County. Supervisor Sunne McPeak expressed her support for the TSM ordinance. She urged that compliance with the requirements of the TSM ordinance be required as a condition of new development. She also recommended that existing employers be encouraged to participate in TSM programs. Supervisor Tom Powers stated that the TSM ordinance is an integral part of dealing with the problem of traffic congestion on the County' s roads. He commented on the need to assure that all cities are aware of the ordinance. Supervisor Powers suggested that forums be conducted throughout the County to explain the ordinance and the implementation of it to all the cities. Supervisor Robert Schroder noted that CCTAC represents the cities and the general public as well as the County and recommended that CCTAC conduct such public forums. Supervisor Tom Torlakson, Chairman of CCTAC, agreed on behalf of CCTAC to conduct Countywide forums on the TSM ordinance. Supervisor Schroder suggested that staff work with such agencies as the Metropolitan Transportation Commission (MTC) , Association of Bay Area Governments (ABAG) , and the Bay Area Air Quality Management District (BAAQMD) to develop a regional TMS program. There being no further discussion, IT IS BY THE BOARD ORDERED that the Director of Community Development is DIRECTED to review a policy of requiring compliance with the TSM ordinance as a condition for new development. IT IS FURTHER ORDERED that Community Development Department staff is DIRECTED to encourage existing employers to participate in TSM programs. IT IS FURTHER ORDERED that CCTAC is REQUESTED to conduct public forums throughout the County to explain the TSM ordinance to other jurisdictions and the general public.
