ADOPT Resolution No. 2014/390 vacating 0.98 miles of excess road right-of-way from Ferndale Road to Pereira
Road in the Martinez area and reserving and excepting therefrom an easement for vehicular and non-vehicular trails
for the County Feeder Trail No. 1, pursuant to Division 9, Part 3, Chapter 4 of the Streets and Highways Code,
commencing with Section 8330, et seq. CP #14-32 (Project No.: 0676-6Q1811)
DIRECT the Real Estate Division to record a certified copy of the Resolution in the office of the County Recorder.
DETERMINE that the summary vacation of the above-described section of roadway and reservation and exception
of the above-described easement is not subject to the California Environmental Quality Act (CEQA), pursuant to
Article 5, Section 15061(b)(3) of the CEQA Guidelines.
DIRECT the Conservation and Development Director, or designee, to file a Notice of Exemption with the County
Clerk and DIRECT the Public Works Director, or designee, to pay the Department of Conservation and Development
$25.00 to process the Notice of Exemption, and pay the County Clerk $50.00 to file the Notice of Exemption.

Subject:ADOPT Resolution No. 2014/390 vacating excess road right of way and reserving an easement for trails; and
APPROVE related CEQA actions, Martinez area.
FISCAL IMPACT:
100% East Bay Regional Park District Funds.
BACKGROUND:
On April 22, 2014, the Board of Supervisors approved a Cooperative Funding Agreement between Contra Costa
County (County) and East Bay Regional Park District (EBRPD) to assign and vacate a segment of excess road
right-of-way, for Feeder Trail No. 1, between Ferndale Road and Pereira Road in the Martinez area.
EBRPD is requesting that the County vacate and assign its interest between Ferndale Road and Pereira Road so
that it can be maintained and patrolled by EBRPD in order to improve safety and active public use.
The County no longer requires the right-of-way for the above-described section from Ferndale Road to Pereira
Road for County highway purposes. The above-described section from Ferndale Road to Pereira Road is
impassible for vehicle travel, and, for at least the past five years, no County funds have been used to maintain that
segment of roadway as a County highway. Public Works Department staff concluded there are no known public
utility facilities within the above-described section from Ferndale Road to Pereira Road.
EBRPD desires to convert the above-described 0.98-mile section of road right-of-way to a Class I multi-use
bicycle/pedestrian trail, and to repair the existing pavement with slope stability improvements (the “Project”). On
or about March 13, 2012, the County and EBRPD entered into a memorandum of understanding to define the
parties’ respective Project-related obligations. Therefore, the County is reserving and excepting from this vacation
an easement for vehicular and non-vehicular trail uses.
Public Works Department staff concluded that it can be seen with certainty that there is no possibility that this
action may have a significant adverse effect on the environment (CP #14-32).
Public Works Department staff recommends that the Board of Supervisors adopt Resolution No. 2014/390, and
take the other actions specified above.
CONSEQUENCE OF NEGATIVE ACTION:
The County would continue to be liable for the maintenance of excess road right-of-way no longer needed for
County highway purposes.
CHILDREN'S IMPACT STATEMENT:
