CONSIDER waiving the 180 day “sit out” period for Mr. Steven Jordan, Senior Capital Facilities Project Manager, in the Public Works Department. 2. FIND that the appointment of Mr. Jordan is necessary to fill a critically needed position. 3. APPROVE and AUTHORIZE the hiring of retiree Steven Jordan as a temporary County employee for the period of October 14, 2014 until vacant positions are filled and staff trained, not to exceed December 31, 2015, as recommended by the Public Works Director. FISCAL IMPACT: Salary costs are included in the Department’s operating budget. There will be salary and employment tax payments for the hours provided of approximately $55,540.00, for up to 900 hours per fiscal year. These costs will be offset by savings due to the vacancy of the permanent position. Bueren, Public Works Director/Chief Engineer Date:October 7, 2014 Contra Costa County Subject:Temporary Hire of County Retiree - Waiver of 180 day "sit out" period BACKGROUND: The Public Employee Pension Reform Act of 2013 requires that active members who retire on or after January 1, 2013 must wait 180 days after retirement before returning to work as a temporary employee. The Act also allows the Board, based on a finding that the appointment is necessary to fill a critically needed position, to waive the 180 day “sit out” period. Mr. Jordan started working for the County as an Associate Architectural Engineer in 1988 and was an excellent employee for the County during his tenure. While the Department continues with a recruitment effort to backfill this and other positions within the Capital Projects Division, we need the knowledge of Mr. Jordan to continue to provide services to our customer departments throughout the County. He was working on several critical projects for the County at the time of his retirement including the Finance Building and the Regional Renewable Energy (solar) Procurement Project which are expected to be completed in the third quarter of 2015. We do not have adequate staffing in the Department to redistribute this work and sustain services. Mr. Jordan would help provide a level of service to keep these projects moving forward. It would be the Department’s intent to keep Mr. Jordan until a recruitment effort could be completed and some cross training and succession planning could be done. CONSEQUENCE OF NEGATIVE ACTION: Failure to receive Board approval will result in a significant negative impact in the department’s ability to provide necessary critical services.
