APPROVE the Upper Sand Creek Basin project contingency fund increase of $1,000,000 for a new contingency fund
total of $2,911,688.50, and a new payment limit of $12,028,573.50, effective October 7, 2014, as recommended by
the Chief Engineer; and,
APPROVE and AUTHORIZE the Chief Engineer, or designee, to execute Contract Change Order No. 11 with
Goodfellow Top Grade Construction, LLC, effective October 7, 2014, for a total amount not to exceed $1,435,000 to
settle all claims on the above project, including Notices of Potential Claims Nos. 1-8 and disputed earthwork
quantities. (Project No. 7562-6D8518-10)
FISCAL IMPACT:
The increase in contingency funds will be funded by 100% Drainage Area 130 funds.
BACKGROUND:
The Project contingency funds are currently insufficient to cover the increased cost. The Contractor has filed eight
Notices of Potential Claim on the project related to project delays, weather delays, and changes in construction means
and methods to adapt to field constructability constraints, including constructing the dam embankment in stages and

BACKGROUND: (CONT'D)

changing from trenching to open cut for the outlet works pipe installation. Earthwork quantities, and the need to
double-handle material due to changes in means and method, have also been disputed by the contractor. If
approved by the Board, this change order would constitute a global settlement of all potential claims and disputes
on the project. Otherwise, if not approved, the Contractor's claims would remain and the change order could not be
used against the District.
CONSEQUENCE OF NEGATIVE ACTION:
The lack of approval would preclude payment of the Contractor's claims on the above project and would delay
final project close-out.
