APPROVE and AUTHORIZE the Chief Engineer, or designee, to execute Amendment No. 4 of the Consulting
Services Agreement (CSA) with Consolidated CM (CCM), effective October 1, 2014, to increase the payment limit
by $200,000 to a new payment limit of $2,557,773, and extend the termination date from October 1, 2014 to June 1,
2015 in order to provide construction management services for the Upper Sand Creek Basin Project, Antioch area.

FISCAL IMPACT:
CSA Amendment No. 4 allows for an increase in the payment limit. The increase is to be funded by 100% Drainage
Area 130 funds.
BACKGROUND:
The Upper Sand Creek Basin project is being constructed on Sand Creek to improve the flood protection to
downstream residents. Due to the large size of the project site, continued project delays, and eight notices of potential
claims being filed, the Consultant is providing additional staff time and sub-consultant services on the project.

BACKGROUND: (CONT'D)
On March 12, 2013, the Board of Supervisors approved the CSA for construction management services for the
construction of the project with Consolidated CM.
On December 3, 2013, the Board of Supervisors approved Amendment No. 1 increasing the payment limit for
additional construction management services.
On February 11, 2014, the Board of Supervisors approved Amendment No. 2 increasing the payment limit for
additional construction management services.
On May 13, 2014, the Board of Supervisors approved Amendment No. 3 increasing the payment limits for additional
construction management services for additional staff time due to continuing delays and four notices of potential
claims being filed.
Proposed Amendment No. 4 will amend payment limits and amend the contract termination date in order to provide
additional construction management services.
CONSEQUENCE OF NEGATIVE ACTION:
Public Works staff does not have the expertise to perform this work in-house. The consultant may not get
compensated for their work.
