HomeMy WebLinkAboutMINUTES - 09232014 - D.6RECOMMENDATION(S): CONTINUE the public hearing on the appeals filed by Communities for a Better Environment and Shute, Mihaly, and Weinberger, LLP (on behalf of the Rodeo Citizens Association) to December 16, 2014, at 9:00 a.m. in order to allow public notice and review of the Recirculated Draft Environmental Impact Report (RDEIR) and a response to comments in accordance with the California Environmental Quality Act. FISCAL IMPACT: The applicant has paid the initial application deposit and is obligated to pay supplemental fees to cover expenses and costs associated with the application processing. BACKGROUND: Phillips 66 Company proposes to implement and construct the Propane Recovery Project, which includes recovering propane and additional amounts of butane for sale and a reduction in sulfur dioxide emissions from the refinery. A Final environmental Impact Report (FEIR) was prepared and completed on November 6, 2013. On November 19, 2013, a public hearing was held before the County Planning Commission that concluded with a unnanimous vote to certify the FEIR and approve the land use permit application. Two appeals were filed by Communities For A Better Environment and Shute, Mihaly, & Weinberger LLP (on behalf of the Rodeo Citizens Association). After hearing public testimony, the Board continued this item to April 1, 2014, June 3, 2014, and then to September 23, 2014 with direction for staff to work with the Bay Area Air Quality Management District regarding a January 14, 2014 letter and to recirculate portions of the environmental impact report. County staff continues to work diligently with the Air District, applicant, and the County's consultant and anticipates release of the Recirculated Draft EIR to the public in October of this year. CONSEQUENCE OF NEGATIVE ACTION: The earlier direction to staff to revise and recirculate portions of the Draft Environmental Impact Report for public review will not be fully implemented. CHILDREN'S IMPACT STATEMENT: This is a request to continue a public hearing on the appeals of the County Planning Commission decision to approve the Propane and Butane Recovery Project, no impacts associated.
