HomeMy WebLinkAboutMINUTES - 09232014 - C.01RECOMMENDATION(S): APPROVE and AUTHORIZE the Assignment of a Slope Easement on behalf of Contra Costa County (County) to the State of California (State) over right of way described within the boundaries of Parcel 62938 in connection with the State Route 4 – Bailey Road to Railroad Avenue Project, and FIND that the slope easement is not required for County use, pursuant to Government Code Section 25365. Project No. 4660-6X4258. AUTHORIZE the Chair, Board of Supervisors, to execute said Assignment of Easement on behalf of the County. DIRECT the Real Estate Division of the Public Works Department to deliver a certified copy of this Board Order with the Assignment of the Slope Easement to the State for acceptance and recording in the office of the County Recorder. FISCAL IMPACT: The activity is funded by the Contra Costa Transportation Authority. SCH No. 90030377. Bueren, Public Works Director/Chief Engineer Date:September 23, 2014 Contra Costa County Subject:Assignment of a Slope Easement over a portion of right of way on the State Route 4 – Bailey Road to Railroad Avenue Project, Pittsburg area. BACKGROUND: The County acquired various property rights in connection to the highway widening project. Provision 2e of the Final Order of Condemnation (FOC) identified as Case No. C92-01462, covering Parcel 2 (50862-2), Parcel 5 (50860-5), and a portion of Parcel 2C (50860-2C) recorded October 13, 1993 in Book 19039, Page 825, as Document Number 93-285504, Official Records Contra Costa County, stipulates, in part, β€œthe transfer of such easements shall include a requirement that the transferee maintain such easements.” In order for the State to maintain said easements which are described within the boundaries of Parcel 62938, it is necessary for the County to assign the easement rights. CONSEQUENCE OF NEGATIVE ACTION: The County will not be in compliance with the terms and conditions of the FOC. CHILDREN'S IMPACT STATEMENT: Not applicable ATTACHMENTS Assignment of Easement
