ADOPT Resolution No. 2014/341 approving the Side Letter between Contra Costa County and Professional &
Technical Engineers, Local 21 to modify the parties' Memorandum of Understanding (MOU) to confirm Fire Service
Emergency Recall and Standby Differential.
FISCAL IMPACT:
Eligible employees receive a salary differential in the amount of five percent (5%) of monthly base salary when
assigned a minimum of two (2) weeks each month or two and one-half percent (2.5%) when assigned a minimum of
one (1) week each month. Currently two employees receive the differential and the District has requested that one
additional employee be assigned Recall and Standby. The total annual cost is estimated to be $15,500.
BACKGROUND:
A new Memorandum of Understanding (MOU) between Contra Costa County (County) and the Professional &
Technical Engineers, Local 21 (Local 21) for the period of July 1, 2012 through June 30, 2016, was approved by the
Board of Supervisors on April 22, 2014 (Resolution No. 2014/132).

BACKGROUND: (CONT'D)
On May 20, 1997, the Board of Supervisors adopted Resolution No. 97/273 which modified the Management
Resolution to authorize a Fire Services Emergency Recall and Standby Differential for certain management and
unrepresented employees. The differential was not included in Local 21's MOU; however employees have been
receiving the differential since Local 21 formed. Recently the District requested that an employee be newly
assigned the differential. The request triggered a review of the pay code. The Auditor's Office could find no
authority for the addition and denied the District's request. The District requested that the MOU be modified to
add the differential and the County and Local 21 agreed.
A Side Letter modification to the MOU is required to confirm eligibility for the Fire Service Emergency Recall
and Standby differential. The Side Letter is effective immediately upon adoption.
CONSEQUENCE OF NEGATIVE ACTION:
Employees assigned to standby and emergency recall will not continue to receive the Fire Service Emergency
Recall and Standby differential.
